MINUTES OF A CALLED SESSIONOF THE COUNCIL OF THE TOWN OF The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on February 22, 2007, in the Eagleville Community Center with Mayor Nolan S. CALL TO ORDER The meeting was Called to Order by Mayor Nolan Barham. ROLL CALL A roll call was taken by City Recorder Michelle Bennett. All members were present. INVOCATION Moment of Silence. PLEDGE OF ALLEGIANCE Councilman Smitty led the Pledge of Allegiance to the flag. MAYOR'S WELCOME Mayor Barham welcomed everyone to the City Council meeting. SPECIAL RECOGNITION – Fire Chief Joe Jackson Mayor Barham asked Fire Chief Joe Jackson and his mother Fakie Bracey to come before the Council and guests. In Recognition of his 17 years of service to the Eagleville Fire Department and District 45, Michelle Bennett, City Recorder, presented him with a plaque of appreciation from the Mayor, Council, Fire Department and staff. Chief Jackson was very appreciative in his remarks and indicated that he has enjoyed his time in this capacity with the citizens of Eagleville and the Fire District. EVERETT STONE Everett Stone stood before the Mayor, Council, Staff and Citizens and read a heartfelt letter regarding his tenure with the Eagleville Community and his resignation as Police Chief. CITIZEN’S INPUT Numerous people made comments during the citizens input. A list of those speaking is attached to the minutes and is on file at City Hall. APPROVAL OF MINUTES Mayor Barham asked for a motion to approve the January, 2007 and the February 15, 2007, minutes. Councilman M.A. Smitty made the motion with Councilman Terry Zumbro seconding. A roll call vote was administered by Michelle Bennett and the motion passed 5-1 with Councilman Buchanan voting no. FINANCIAL STATEMENT Mayor Barham asked for a motion to adopt the Financial Statement. Vice-Mayor Ronnie Hill moved and Councilman Greg Buchanan seconded. After discussion, a roll call vote was administered by Michelle Bennett and the motion passed unanimously. ADDITIONS / DELETIONS TO AGENDA Ø Councilman Greg Buchanan asked that procedures for past due property and business taxes be addressed. Mayor Barham stated this would be added under New Business. Ø Vice-Mayor Hill asked that Attorney Travis M. Lampley explain the procedure for adjourning a council meeting. Mayor Barham stated this would be added under New Business. OLD BUSINESS Park Update Ø Vice-Mayor Ronnie Hill stated that most of the fixtures are in the concession stands. Ø The bases have been purchased for the fields. Ø The bleachers have been put together and in place. Ø The first games are scheduled for April 13, 2007. STC Cable Ordinance #07-01 – Third and Final Reading Mayor Barham stated that the change in Section 3A was for eight years instead of fifteen. Councilman Smitty made the motion to approve the STC Cable Ordinance #07-01 on Third and Final Reading with the change for the eight years. Vice-Mayor Ronnie Hill seconded the motion. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. Coffey Annexation Ordinance #07-01 – Second Reading Councilman Vincion made the motion to approve the Coffey Annexation and Councilman Terry Zumbro seconded. There was no discussion. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Resolution #R-07-02 – TDOT Safe Route to School Program Grant Mayor Barham presented the Council with Resolution #07-02 – TDOT Safe Route to School Program Grant. After discussion Councilman Harold Vincion made the motion to accept and it was seconded by Councilman Terry Zumbro. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. NEW BUSINESS Ø Resignation of Everett Stone as Police Chief Mayor Barham stated that because of the inquiry to the P.O.S.T. there is a legal investigation going on with the police department. Attorney Lampley recommended that the Council not accept the resignation of Police Chief Everett Stone as police chief, but to place Mr. Stone on Administrative Leave without pay pending the investigation of the P.O.S.T. Commission. Mayor Barham stated that he had been in contact with Sheriff Truman Jones and we would be well covered with Rutherford County Deputies. Councilman Smitty made the motion to accept Attorney Lampley’s recommendation that we put Chief Stone on administrative leave without pay. Councilman Greg Buchanan seconded. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Ø Police Recommendation – Mayor Barham Mayor Barham decided to skip this section due to the previous discussion. Ø Ordinance #07-02 – Budget Reconciliation – First Reading Mayor Barham presented the Council with ordinance #07-02 – Budget Reconciliation for the first reading. Councilman Terry Zumbro made the motion to accept and it was seconded by Councilman Smitty. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. Ø Ordinance # 07-03 – Code of Ethics – First Reading Mayor Barham presented the Council with Ordinance # 07-03 – Code of Ethics for first reading. Councilman Harold Vincion made the motion to accept and Councilman David Rigsby seconded. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Ø Orientation / Seminars Mayor Barham stated that it is State mandated that the Planning Commission have 4 hours of continuing education to be certified. The same goes for the Certified City Recorder. The only group that is not required by state law to have any training is the City Council. Councilman Greg Buchanan suggested that Council members should try to attend MTAS Conferences whenever possible. The Council has a copy of recent conference meeting dates. Ø Procedures for Past Due Property and Business Taxes City Recorder, Michelle Bennett, requested procedures for past due property and business taxes from the Council. This issue was referred to Attorney Travis Lampley. Ø Procedures for Adjournment of City Council Meetings Vice-Mayor Ronnie Hill moved to always dismiss Council meetings with the Mayor asking for a motion for adjournment and receives a second with a majority vote. This was seconded by Councilman Smitty. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. COUNCIL BOARD, SPECIAL REPORTS Fire Board Report Ø Councilman Harold Vincion told the Council that the Fire Board had met twice since Joe decided to retire. Councilman Vincion stated that the Fire Board recommends that the City Council appoint Tony Jackson as Interim Fire Chief until a permanent chief was hired and be paid a salary of $300 a month. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. Beautification Report Ø Councilman Greg Buchanan told everyone that the Easter Egg Hunt/Breakfast would be March 31st at the Eagleville Community Center. MAYOR’S CLOSING REMARKS Ø Mayor Barham thanked everyone for attending the meeting. He again thanked Fire Chief Joe Jackson for his service to Eagleville and Fire District 45. ADJOURNMENT With no further business to discuss, Mayor Barham asked for a motion to adjourn. Councilman Smitty made the motion to adjourn and Councilman Greg Buchanan seconded. By unanimous vote, the meeting was adjourned at 8:47 p.m. The motion was passed by a unanimous “Aye” vote.
