MINUTES OF A CALLED SESSIONOF THE COUNCIL OF THE TOWN OF The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on October 26, 2006, in Eagleville City Hall with Mayor Nolan S. ROLL CALL A roll call was taken by City Recorder Michelle Bennett. All members were present except Councilman David Rigsby. INVOCATION A moment of silence was observed. PLEDGE OF ALLEGIANCE Mayor Barham led the Pledge of Allegiance to the flag. MAYOR'S WELCOME Mayor Barham welcomed everyone to the City Council meeting. RECESS CITY COUNCIL MEETING Mayor Barham recessed the City Council meeting. CALL TO ORDER PUBLIC HEARING Mayor Barham asked for any comments on the following: Ø Annexation Ordinance #06-02. o No comments. Ø FEMA Ordinance #06-03. o No comments. ADJOURNMENT OF PUBLIC HEARING With no comments being offered, Mayor Barham adjourned the public hearing. CALL BACK TO ORDER CITY COUNCIL MEETING Mayor Barham called the City Council meeting back to order. CITIZEN’S INPUT None. SPECIAL GUEST Gary Cobbs, YMCA Mr. Gary Cobbs, YMCA Middle Tennessee District Executive, thanked everyone for allowing him to attend the meeting and speak regarding YMCA. The YMCA’s mission is to serve the people in Middle Tennessee, which means serving 1 in 5 individuals in Middle Tennessee. They would basically like to have a facility available within 15 minutes of everyone in the Middle Tennessee area. He stated that he was asking the Council to explore opportunities and what the possibility of a YMCA in Eagleville would mean for the community of Eagleville in the future. After discussion everyone thanked Mr. Cobbs for his interest in Eagleville and told him how much they appreciated him taking time to attend the meeting. APPROVAL OF MINUTES Mayor Barham asked for a motion to approve the September, 2006, minutes. Councilman Terry Zumbro made the motion with Councilman Greg Buchanan seconding. A roll call vote was administered by Michelle Bennett and the motion passed 5-0. FINANCIAL STATEMENT Mayor Barham asked for a motion to approve the Financial Statement. Councilman Smitty made the motion and Councilman Terry Zumbro seconded. After discussion, a roll call vote was administered by Michelle Bennett and the motion passed unanimously. ADDITIONS / DELETIONS TO AGENDA Councilman Greg Buchanan requested to add a security system to the new business items. OLD BUSINESS Park Update Ø Vice-Mayor Ronnie Hill explained that S & W is currently working to get the lights hooked up to the building. Ø They are still 2 reimbursements to be sent from the State of Tennessee. Ø Chief Stone has been working on the electrical service and the rough in is ready to be inspected and approved. Ordinance #06-01 – STC Cable – Vince King – Second Reading Mayor Barham suggested to again defer this issue to next month’s meeting. Councilman Smitty made the motion to defer and Councilman Vincion seconded. A roll call vote was administered by Michelle Bennett and the motion passed 5-0. Ordinance #06-02 – Annexation of U.S 41A, U.S. 31A, State Route 99, State Route 269 - Second Reading Mayor Barham asked for a motion for approve Ordinance #06-02 – Annexation of U.S 41A, U.S. 31A, State Route 99, State Route 269 on second reading. Councilman Harold Vincion made the motion to approve and Councilman Zumbro seconded. Attorney Greg Reed made the comment that the ordinance needs to be changed to Town instead of City. Councilman Vincion made the statement that Linda, former City Recorder, mentioned an amendment to change the name from Town to City was made back in the 80’s. This will be investigated further. Councilman Smitty stated that he had a gentleman inquired about being annexed into city limits. He lives at the corner of 41-A and River Eagleville Road. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. FEMA Ordinance #06-03 – Second Reading Mayor Barham asked for a motion for approve the FEMA Ordinance #06-03 on second reading. Councilman Smitty made the motion and Councilman Buchanan seconded. A roll call vote was administered by Michelle Bennett and the motion passed 5-0. NEW BUSINESS Fee Schedule Mayor Barham told the Council that the new Rutherford County Fee Schedule is in their packets. He recommended that this issue be deferred until the November meeting. Councilman Smitty made the motion to defer this until next month. Councilman Greg Buchanan seconded the motion. A roll call vote was administered by Michelle Bennett and the motion passed 4-1, with Vice-Mayor Hill voting no. Ordinance #06-04: 281 Hwy 99 Rezoning - First Reading The Planning Commission’s Secretary, Councilman Harold Vincion, presented the Council with an ordinance to rezone the property at 281 Hwy 99 from R2 to R3, for a multifamily dwelling. This was approved by the Planning Commission. After discussion, a roll call vote was administered by Michelle Bennett and the motion passed 4-0-1, with Councilman Smitty abstaining. Ordinance #06-05: Personnel Policies and Procedures – First Reading Mayor Barham presented the Council with a draft of the Personnel Policies and Procedures with changes from the Council work-session meeting. After discussion and a few changes, Councilman Harold Vincion made the motion to approve with Councilman Greg Buchanan seconding. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Security System Councilman Greg Buchanan presented the Council with information regarding a Security System for City Hall from Advanced Alarm Technologies. He stated that he had talked to Michelle earlier in the week and found out that City Hall does not have a security system. Michelle told him of a company that was very reasonable and gathered some information for Council. The Council agreed to take this into consideration, read over the material, and discuss it at the next meeting. COUNCIL BOARD, SPECIAL REPORTS Police Board Report Ø Chief Stone reported that he has had a few problems with some kids in Eagleville. He has started working the night shift to keep an eye on this problem. Ø Chief Stone is requesting extra help from the Fire Department again this year on Halloween. Ø There have also been a few issues and concerns brought to his attention regarding code violations around town and he is in the process of addressing this problem. Fire Board Report None. Beautification Report Ø Councilman Greg Buchanan told the Council that the Beautification Committee’s next meeting is, Thursday, November 2, 2006. Ø He also reminded everyone of the Christmas Parade, which will be on Saturday, December 2, 2006. MAYOR’S CLOSING REMARKS Ø Mayor Barham emphasized to take home the insert in the packets on Urban Growth and read it. ADJOURNMENT With no further business to discuss, Mayor Barham asked for a motion to adjourn. Councilman Smitty made the motion to adjourn and Councilman Terry Zumbro seconded. By unanimous vote, the meeting was adjourned at 8:07 p.m. The motion was passed by a unanimous “Aye” vote.
