MINUTES OF A CALLED SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

November 16, 2006 

The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on  November 16, 2006, in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham. 

 

ROLL CALL

            A roll call was taken by City Recorder Michelle Bennett.  All members were present.   

INVOCATION

Councilman M. A. Smitty delivered the invocation.   

PLEDGE OF ALLEGIANCE

Vice-Mayor Ronnie Hill led the Pledge of Allegiance to the flag. 

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

SPECIAL RECOGNITIONS

Fire Chief Joe Jackson recognized Assistant Fire Chief Jeff Mooneyham, Firefighter Andy Jeanette, Rutherford County Sheriff Deputy Jay Jones and Police Chief Everett Stone for heroism and bravery on November 9, 2006, with plaques.   

RECESS CITY COUNCIL MEETING

Mayor Barham recessed the City Council meeting.

CALL TO ORDER PUBLIC HEARING

            Mayor Barham called to order a public hearing and asked for any comments on the following:

Ø      STC Ordinance #06-01. 

o       No comments. 

Ø      281 Hwy 99 Rezoning Ordinance #06-04. 

o       No comments. 

Ø      Personnel Policies and Procedures Ordinance #06-05. 

o       No comments.   

ADJOURNMENT OF PUBLIC HEARING

With no comments being offered, Mayor Barham adjourned the public hearing.  

CALL BACK TO ORDER CITY COUNCIL MEETING

Mayor Barham called the City Council meeting back to order.   

CITIZEN’S INPUT

            None.   

APPROVAL OF MINUTES

            Mayor Barham asked for a motion to approve the October, 2006, minutes.  Councilman Terry Zumbro made the motion with Councilman M.A. Smitty seconding.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0. 

FINANCIAL STATEMENT

            Mayor Barham asked for a motion to approve the Financial Statement.  Vice-Mayor Ronnie Hill made the motion and Councilman Terry Zumbro seconded.  After discussion, a roll call vote was administered by Michelle Bennett and the motion passed unanimously.

AUDIT REPORT – John Poole

            Not present.   

ADDITIONS / DELETIONS TO AGENDA

Mayor Barham requested to add Mr. Vince King, STC Cable, to the old business items. 

OLD BUSINESS

Park Update

Ø      Vice-Mayor Ronnie Hill explained that the lights are working. 

Ø      We are still waiting on 2 reimbursements to be sent from the State of Tennessee.    

Ø      Chief Stone has been working on the electrical service and the rough in is ready to be inspected and approved.   

Ordinance #06-01 – STC Cable – Vince King – Second Reading

            Mayor Barham asked for a motion to approve.  Councilman Smitty made the motion to approve and Councilman Harold Vincion seconded. 

After much discussion a roll call vote was administered by Michelle Bennett and the motion passed unanimously.  

Ordinance #06-02 – Annexation of U.S 41A, U.S. 31A, State Route 99, State Route 269 – Third and Final Reading

            Mayor Barham asked for a motion for approve Ordinance #06-02 – Annexation of U.S 41A, U.S. 31A, State Route 99, State Route 269 on third and final reading.  Councilman Smitty made the motion to approve and Councilman Harold Vincion seconded. 

After discussion a roll call vote was administered by Michelle Bennett and the motion passed 6-0.

Ordinance #06-03– FEMA: Third and Final Reading

            Mayor Barham asked for a motion for approve the FEMA Ordinance #06-03 on third and final reading.  Councilman Harold Vincion made the motion to approve and Councilman David Rigsby seconded.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.

Ordinance #06-04 – 281 Hwy 99 Rezoning: Second Reading

            Mayor Barham asked for a motion for approve Ordnance #06-04 on second reading.  Vice-Mayor Ronnie Hill made the motion to approve and Councilman David Rigsby seconded.  A roll call vote was administered by Michelle Bennett and the motion passed 5-0-1, with Councilman Smitty abstaining.    

Ordinance #06-05 – Personnel Policies and Procedures:  Second Reading

            Mayor Barham asked for a motion for approve Ordinance #06-05 on second reading.  Councilman Terry Zumbro made the motion to approve and Councilman David Rigsby seconded.  After discussion, a roll call vote was administered by Michelle Bennett and the motion passed 6-0.

New Fee Schedule

            Mayor Barham asked for a motion for approve the new fee schedule that the Council had received and reviewed at the October meeting.  Vice-Mayor Ronnie Hill made the motion to approve and Councilman Terry Zumbro seconded.  Mayor Barham stated that this would go into effect immediately if passed.  A roll call vote was administered by Michelle Bennett and the motion passed 5-1, with Councilman Smitty voting no.  

Security Alarm – Greg Buchanan

            Councilman Greg Buchanan presented the council with several bids from different alarm companies.  The council agreed to accept the bid from Advanced Technology.  Vice-Mayor Ronnie Hill made the motion and Councilman Terry Zumbro seconded.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.  

NEW BUSINESS

Greg Reed – Resignation

Mayor Barham stated that Attorney Greg Reed mailed all Council Members a resignation letter effective December 31, 2006.  Mayor Barham stated that he had written a return letter stating that we would honor his request reluctantly. 

Mayor Barham asked for a motion to approve Attorney Greg Reed’s letter of resignation.  Councilman Harold Vincion made the motion and Councilman Greg Buchanan seconded.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously with many regrets. 

Street Lights – Councilman Smitty

            Councilman Smitty stated that he drove around Eagleville a few nights ago and written a list of all the street lights that were not working.  Mayor Barham stated that he needs to turn them into Michelle or Chief Stone.  Chief Stone or Ed Wettig will then go around and mark the poles.  The Mayor explained that Michelle faxes the list to MTE once a month. 

COUNCIL BOARD, SPECIAL REPORTS

Police Board Report

Ø      Chief Stone reported that a citizen had dumped trash in front of City Hall last week.  Chief Stone stated that he cleaned it up and will take care of the problem. 

Ø      The vandals that went around and destroyed mailboxes in the area were caught. 

Ø      The drug store had another attempted robbery, but the burglar did not enter.  The Drug Store has a video system now.  So, they have a good picture of him.   

Fire Board Report

Chief Jackson stated that he had attended a federal mandated class for driving emergency vehicles.  All personnel who drive emergency vehicles are required to take this class.   

Beautification Report

Ø      Councilman Greg Buchanan reminded everyone of the Christmas Parade, which will be on Saturday, December 2, 2006, and the Parade of Homes on Sunday, December 10, 2006.

Ø      Councilman Buchanan also stated that the Beautification Committee elected Rita Boyd as the new chairman.  He stated that Debbie Ryan, Melissa Buchanan and Gloria Hill will be retiring from the Beautification Committee at the end of the year. 

Ø      Councilman Buchanan also stated that the Grand Marshall of the Christmas Parade is going to be Jane & Leon Puckett. 

Ø      Chief Stone requested help with traffic during the Christmas Parade. 

John Redmond Bridge – Vice-Mayor Ronnie Hill

            Vice-Mayor Hill stated that a citizen asked him about the naming of the John Redmond Memorial Bridge.  Mayor Barham stated that the Private Act had been passed, but we have not received it.  The County has supposedly paid the $325 for the sign.  He believes this is the hold up.  Councilman Smitty stated that he had a citizen offering to pay this if needed.   

MAYOR’S CLOSING REMARKS

Ø      Mayor Barham thanked everyone for their time as always.  He also reminded everyone that the December meeting will be on Thursday, December 7, 2006.  He stated that we will have Christmas goodies after the meeting.   

ADJOURNMENT

With no further business to discuss, Mayor Barham asked for a motion to adjourn.  Councilman Smitty made the motion to adjourn and Councilman David Rigsby seconded.  By unanimous vote, the meeting was adjourned at 8:21 p.m.  The motion was passed by a unanimous “Aye” vote.
