MINUTES OF A CALLED SESSIONOF THE COUNCIL OF THE TOWN OF The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on December 7, 2006, in Eagleville City Hall with Mayor Nolan S. ROLL CALL A roll call was taken by City Recorder Michelle Bennett. All members were present. INVOCATION Councilman Harold Vincion delivered the invocation. PLEDGE OF ALLEGIANCE Mayor Barham led the Pledge of Allegiance to the flag. MAYOR'S WELCOME Mayor Barham welcomed everyone to the City Council meeting. asked for any comments on the following: CITIZEN’S INPUT None. APPROVAL OF MINUTES Mayor Barham asked for a motion to approve the November, 2006, minutes with Greg Reeds corrections. Councilman Terry Zumbro made the motion with Councilman David Rigsby seconding. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. FINANCIAL STATEMENT Mayor Barham asked for a motion to adopt the Financial Statement. After discussion regarding Daily News Journal, Pitney Bowes and the Park drywall bills, Councilman Smitty moved and Councilman Harold Vincion seconded. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. ADDITIONS / DELETIONS TO AGENDA Ø Mr. Coffey Ø New Attorney OLD BUSINESS Park Update Ø Vice-Mayor Ronnie Hill stated that the bathrooms are just about finished. Ø The Concessions stand and the score keeper’s room has been sheet rocked and just about finished. Ø He had set out 20 more trees to replace the ones that had died. Ø There are two more reimbursements due from the State that do not reflect in the financial statement. The total is around $23,000. Ordinance #06-01 – STC Cable – Vince King – Third and Final Reading Mayor Barham asked for a motion to approve. Councilman Terry Zumbro made the motion to defer this issue to the February meeting. Councilman Greg Buchanan seconded. After much discussion a roll call vote was administered by Michelle Bennett and the motion passed unanimously. Ordinance #06-04 – 281 Hwy 99 Rezoning: Third and Final Reading Mayor Barham asked for a motion for approve Ordnance #06-04 on third and final reading. Councilman Harold Vincion made the motion to approve and Councilman David Rigsby seconded. A roll call vote was administered by Michelle Bennett and the motion passed 5-0-1, with Councilman Smitty abstaining. Ordinance #06-05 – Personnel Policies and Procedures: Third and Final Reading Mayor Barham asked for a motion for approve Ordinance #06-05 on third and final reading. The Council asked Greg Reed his opinion on the language on page 2 regarding City Recorder being eliminated. Attorney Reed agreed and Michelle made the change. Councilman Terry Zumbro made the motion to approve and Councilman David Rigsby seconded. After discussion, a roll call vote was administered by Michelle Bennett and the motion passed 6-0. Mr. Coffey Mayor Barham stated that our City Planner, Bo Logan, would draft an ordinance for the next Planning Commission meeting. After this was agreed upon by the Planning Commission, it would send it to the City Council. NEW BUSINESS Ø Resolution #R-06-09 Mayor Barham asked for a motion to approve Resolution # R-06-09 Plan of Services Annexation for the annexed highways. Councilman David Rigsby made the motion and Councilman Harold Vincion seconded. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Ø Attorney Travis Lampley Mayor Barham stated that he had several people recommend Mr. Travis Lampley for the new City Attorney. Mayor Barham had already met with him and Michelle and Mayor Barham have a meeting with him next week. Mayor Barham asked for a motion to approve a $450 a month salary for a new attorney. Councilman Smitty made the motion and Councilman Greg Buchanan seconded. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. COUNCIL BOARD, SPECIAL REPORTS Police Board Report Ø Chief Stone reported that the Christmas Parade went well. Chief Jackson and one deputy from Rutherford County helped with traffic control. Ø He stated that there are a lot of code violations going on in Eagleville. This is something in his opinion that needs to be addressed by the Council and consequences set in place. Ø Chief Stone and Mayor Barham stated that they and Michelle have talked to Judge Messick about City Court. This will start in February. Fire Board Report Michelle stated that Chief Jackson sent his apology for not being in attendance due to a Fire Chief’s meeting. Beautification Report Ø Councilman Greg Buchanan reminded everyone of the Parade of Homes on December 10th. MAYOR’S CLOSING REMARKS Ø Mayor Barham and the City Council presented Michelle with a birthday card and wished her a happy birthday. Ø Again Mayor Barham stated that our attorney would be leaving us soon. He told him that it had been a real honor to work with him for 12 years and thanked him on behalf of the Council and City of Eagleville. A plaque was presented to him in appreciation of his service. Ø Mayor Barham told the Council that he, Carolyn, Michelle and Mike had refreshments for everyone after the meeting. He thanked everyone for their time as always. ADJOURNMENT With no further business to discuss, Mayor Barham asked for a motion to adjourn. Councilman Smitty made the motion to adjourn and Councilman David Rigsby seconded. By unanimous vote, the meeting was adjourned at 7:49 p.m. The motion was passed by a unanimous “Aye” vote.
