MINUTES OF A CALLED SESSIONOF THE COUNCIL OF THE TOWN OF The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on August 24, 2006, in Eagleville City Hall with Mayor Nolan S. ROLL CALL A roll call was taken by City Recorder Michelle Bennett. All members were present except for Councilman Zumbro. INVOCATION Mayor Barham asked for a moment of silence PLEDGE OF ALLEGIANCE Taylor Bennett led the Pledge of Allegiance to the flag. MAYOR'S WELCOME Mayor Barham welcomed everyone to the City Council meeting. CITIZEN’S INPUT Ø Ms. Emily Palmer Ms. Emily Palmer addressed the Council regarding the recent publication of the worksheet line item budget in the Eagleville Times. She voiced her concern that she didn’t think it was very appropriate to publish this in the local paper. She stated being in the center of town she hears a lot of conversations and from what she can tell the intention was malicious. She also said that this upset a lot of the older citizens that didn’t understand how to read the worksheet for the budget. She also understood that this was not the public record document obtained from City Hall. Ms. Palmer also stated that she felt it was very inappropriate to publish salaries, along with people’s names in the paper. Her second concern was video cameras in Eagleville. When she opened the restaurant she was told that there were cameras downtown, and understands that this is no longer the case. She would like the City Council and the Police Department to install new cameras. No one had told the local businesses that these cameras were no longer operating. Ms. Palmer stated that she feels that she gives Eagleville 110% and she is here to stay. When she contacted the Activities Committee regarding the Eagleville Fall Festival to have a booth to sell what she sells on a daily basis, she was told that there were outside venders already booked to do that. Her request to the Council was that local food vendors should be invited to the Fall Festival before those who are outside of Eagleville. Mayor Barham thanked Ms. Palmer for her comments. Ø Councilman Greg Buchanan Councilman Greg Buchanan addressed the issue regarding the publication in the Eagleville Times. He agreed, but stated that it is public record. Councilman Buchanan then addressed the Eagleville Fall Festival. He stated that three others had already spoken wanting to do hot dogs and hamburgers, one being the Eagleville Volunteer Fire Department. He apologized that they forgot to come by and ask her first. Ø Attorney Greg Reed Attorney Greg Reed addressed mayor by saying that it was his understanding that what was run in the paper was not sponsored by the City. Mayor Barham stated that Michelle was approached by the editor for the 2006-2007 Budget. She provided them with what had been published in the Daily News Journal and what had been sent to the State. This included the Ordinance passed by the Council, which is required. APPROVAL OF MINUTES Mayor Barham asked for a motion to approve the June 22, 2006, June 26, 2006 and July 27, 2006 minutes. Councilman Smitty made the motion with Councilman Greg Buchanan seconding. A roll call vote was administered by Michelle Bennett and the motion passed 5-0.
ADDITIONS / DELETIONS TO AGENDA Mayor Barham stated that he would like to add Beautification Committee and the City Certificate of Deposit. Vice-Mayor Ronnie Hill stated that he would like to add a place for City Hall being closed on election day and vacation policies. Mayor Barham a Personnel Handbook for the City Council is being written. He asked Vice-Mayor Hill if he would wait to address that when adopting the handbook. Vice-Mayor Hill agreed. Councilman Smitty wanted to add a place for the Financial Statement. OLD BUSINESS Park Update Mayor Barham once again complimented Vice-Mayor Hill and the Park Board for all they do. Vice-Mayor Ronnie Hill stated that there hadn’t been a whole lot of progress made, but there had been some. The scoreboards are up, the light poles are installed. Ronnie stated that there had been 20 loads of fill dirt delivered and the playground equipment is supposed to start being installed Monday morning. Vice-Mayor Hill stated that the car show brought in a little over $5,000. He also stated that Attorney Greg Reed is preparing new contracts for the field naming agreements. Vice-Mayor Hill stated that he was holding a check from one of the people until the agreements are approved and he can get the other check at any time. Bid Contracts Vice-Mayor Hill stated that we had been audited by the State over the past few months. There are a few concerns that needs to be addressed by the Council. He stated there were no bids taken for some of the things that actually added up to be more than $5,000. This was not advertised because the work done and materials bought were stretched out over a period of time. We received prices and realized that the contractors we were using were giving us excellent prices, cheaper than we could get anywhere else. The State requires us to have a contract with the contractors and to be voted on by the Council and approved in order for us to do business with them. Ø The first contract is with Johnson’s Excavating LLC. He provides bulldozier and backhoe work at a rate of $70.00 per hour. His services are as needed. Vice-Mayor Ronnie Hill made the motion to accept Johnson’s Excavating LLC contract. Councilman Greg Buchanan seconded. A roll call vote was administered by Michelle Bennett and the motion passed 5-0. Ø The second contract that Vice-Mayor Hill presented was from Crutcher Trucking and Excavating (J. David Crutcher). He provides dozier work for $70.00. He also has a dump truck and charges $3.25 per ton for gravel. Vice-Mayor Hill made the motion to accept Crutcher Trucking and Excavating, J. David Crutcher’s contract. Councilman Harold Vincion seconded. Attorney Greg Reed interjected during the discussion that he knew for a fact that Vice-Mayor Hill had contacted a number of providers and these prices are a lot less than any he found. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Ø The third contract was for Stone’s Electric. His rate is $75 per hour; Eagleville buys all materials or reimburse Stone’s Electric at his cost. Vice-Mayor Hill made the motion to accept Stone’s Electric contract. Councilman Harold Vincion seconded. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Ø The fourth contract was from Sharon Coffey. She provides fill dirt and hauling at the rate $30.00 per load. Vice-Mayor Hill made the motion to accept Sharon Coffey’s contract. Councilman David Rigsby seconded. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Field Naming Agreements Attorney Greg Reed stated that he is drafting naming agreements. Alan Farley has provided him with MTSU’s policies and procedures for naming fields. He is currently reviewing that and reducing the information to a letter agreement. He will provide a resolution for the field being named after Mr. John Redmond. 2007 Transportation Enhancement Program Application Mayor Barham stated that in the GNRC Region 38% of the Transportation Enhancement Program Grants were awarded. Ours was not. Mayor Barham talked to Tonya Blades and she stated to reapply. This is an 80/20 grant due by November 1st. Councilman Smitty made a motion to approve to re-apply for the 2007 Transport Enhancement Program. Councilman Greg Buchanan seconded the motion. A roll call vote was administered by Michelle Bennett and the motion passed 5-0. NEW BUSINESS Ordinance #06-01 - STC Cable – Vince King – First Reading Vince King, with STC Cable, addressed the council regarding a franchise agreement, which is Ordinance #06-01. Attorney Greg Reed had reviewed the Ordinance presented and made a few cosmetic changes. After discussion Councilman Smitty made the motion to approve Ordinance #06-02 STC Cable – Vince King on the first reading. Councilman David Rigsby seconded the motion. A roll call vote was administered by Michelle Bennett and the motion passed 4-1, with Councilman Greg Buchanan voting no. A copy of the Ordinance is attached with the minutes. code of Ethics – Greg Reed Attorney Reed explained the Code of Ethics to the Council Members. He stated that this is State Law for us to have. After discussion, Councilman Harold Vincion made the motion to add the Code of Ethics to the Municipal Code. Councilman David Rigsby seconded. A roll call vote was administered by Michelle Bennett and the motion passed 5-0. Resolution #R-06-04 THDA Home Program Policy & Procedures Mayor Barham stated that the Council was mailed the THDA Home Program Policies and Procedures to review. After this is discussed and passed, someone from THDA will come out and there will be a public hearing held in Eagleville to start taking applications. By passing this resolution, the Council accepts the Home Program Policies and Procedures. Councilman Harold Vincion made the motion to approve Resolution #R-06-04 THDA Home Program Policies and Procedures with Councilman Greg Buchanan seconding the motion. A roll call vote was administered by Michelle Bennett and the motion passed 4-0, with Councilman Smitty abstaining. Resolution #R-06-05 TO ROUND PROPERTY TAXES, INTERESTS AND PENALTIES Mayor Barham presented the Council with a resolution to round property taxes, interests and penalties. After discussion Mayor Barham entertained a motion. Vice-Mayor Ronnie Hill made the motion to approve Resolution #R-06-05 TO ROUND PROPERTY TAXES, INTERESTS AND PENALTIES. Councilman Harold Vincion seconded the motion. A roll call vote was administered by Michelle Bennett and the motion passed 5-0. Resolution #R-06-06 UNITED WAY Mayor Barham stated that this resolution was just recognizing United Way for 50 years of service. Councilman Smitty made the motion to accept Resolution #R-06-06 UNITED WAY, with Councilman David Rigsby seconding the motion. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Financial Statement Councilman Smitty asked Michelle balances in checking accounts for Street Aid and General Fund. They also discussed any outstanding bills. Councilman Smitty also asked that there be a section for the Financial Statement on the Agenda every month. CD – Regions Bank Mayor Barham
proposed to take out $20,000 from the CD at Regions During discussion Vice-Mayor Ronnie Hill told the Council for clarification that he is the one that gave Debbie the worksheet budget for the Eagleville Times. He stated he wished Ms. Palmer was still present to address that issue. After discussion a roll call vote was administered by Michelle Bennett and the motion passed 5-0. Meeting with all Town Merchants – Camera System There was much discussion regarding purchasing a new camera system and asking town merchants for a donation from all local businesses. Mayor Barham suggested that he would go to each business and speak to the owners personally. Mayor Barham stated that he would meet with the chief and get a report together for the next meeting. Councilman Smitty made a motion to have a meeting with all the Town Merchants. The motion died for a lack of a second. COUNCIL BOARD, SPECIAL REPORTS Police Board Report Chief Stone reported that he had received a quote for a new video camera system. This is the system that the County uses. There are no video tapes, everything is digital. There was much discussion regarding this issue under New Business – Meeting with Town Merchants – Camera System. Councilman Smitty asked Chief Stone when the signs that we received from the sign grant last year would be put up. He again volunteered his time to help install the signs around town. Fire Board Report Chief Jackson stated that he had received notification from the County that the Fire Department would be receiving $25,000 annually. Beautification Report Councilman Greg Buchanan stated that there had already been 30 booths rented for the Eagleville Fall Festival. He also reported a new member was added to the Activities Committee. He gave the Council details of what was planned for the Eagleville Fall Festival. MAYOR’S CLOSING REMARKS Ø Mayor Barham addressed the Council regarding Attorney Request Forms. Attorney Greg Reed stated that if anyone had an issue that needed to be addressed, do not call him, but please fill out these forms, give them to Michelle and she will fax them to his office. That way everything is in writing and there is a record of it. Ø Michelle also reminded everyone there would be a car wash on September 9th at City Hall for the Eagleville Middle School Basketball team. Ø Councilman Smitty noted that he is working on having a downtown yard sale. Ø Mayor Barham thanked everyone for their time. ADJOURNMENT With no further business to discuss, Mayor Barham asked for a motion to adjourn. Councilman Smitty made the motion to adjourn and Councilman David Rigsby seconded. By unanimous vote, the meeting was adjourned at 9:10 p.m. The motion was passed by a unanimous “Aye” vote.
