MINUTES OF A CALLED SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

September 28, 2006 

The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on  September 28, 2006, in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham. 

ROLL CALL

            A roll call was taken by City Recorder Michelle Bennett.  All members were present. 

INVOCATION

Councilman David Rigsby delivered the invocation. 

PLEDGE OF ALLEGIANCE

Councilman Smitty led the Pledge of Allegiance to the flag.

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

CITIZEN’S INPUT

Ø      Ms. Julie Shelton

Ms. Shelton addressed the Council with a few complaints regarding Councilman M.A. Smitty (her neighbor).  Her issues included trespassing on her property and having to call the authorities numerous times about the issue.  

APPROVAL OF MINUTES

            Mayor Barham asked for a motion to approve the August, 2006, minutes.  Councilman Smitty made the motion with Councilman Harold Vincion seconding.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.   

FINANCIAL STATEMENT

            Mayor Barham asked for a motion to approve the Financial Statement.  Vice-Mayor Ronnie Hill made the motion and Councilman Terry Zumbro seconded. 

Discussion

Ø      During discussion Vice-Mayor Ronnie Hill asked about the transfer from Street Aid Savings to the General Fund account.  City Recorder, Michelle Bennett, explained that this was money transferred from the General account to Street Aid checking over the last fiscal year to cover monthly expenses.  During the audit the accountant and auditor suggested not do that anymore.  Since Street Aid money cannot be used for anything else but Street Aid, use that first before taking money out of our General Fund. 

Ø      His second question was regarding the payment to Chappell Smith and Associates out of Street Aid Checking.  Michelle explained that it was the Street Aid Bond. 

Ø      Vice-Mayor Hill also questioned what Ed Wettig was charging the town to pick up trash.  He felt that he didn’t feel that he should be charging the town for this. 

Ø      Councilman Greg Buchanan questioned Mr. Gordon Lamb’s water bill.  He thought it was a little high this month.

Ø      Councilman Buchanan asked about two payments for BCBS of TN.  Mayor Barham explained that one was a back payment. 

Ø      Councilman Buchanan also questioned the cell phone bill.  It was explained that it was four phones. 

A roll call vote was administered by Michelle Bennett and the motion passed unanimously. 

ADDITIONS / DELETIONS TO AGENDA

None.

OLD BUSINESS

Park Update

Ø      Vice-Mayor Ronnie Hill explained that since the last meeting quite a bit had been done at the park.  The Field Agreements had been approved, contracts signed and money received. 

Ø      The playground has been completely installed and paid for. 

Ø      The light poles and lights have been installed.  Last week the trenching and conduit were put in to run electricity to all the fields and buildings. 

Ø      Mr. James Rigsby donated over $800 worth of dozer work a couple of weeks ago.

Ø      One Saturday afternoon a few volunteers grated and put straw down. 

Ø      A dirt burm was installed around the South and Western sides.  Hopefully this will keep the water from coming across the baseball field and can be the basis for the start of the walking trail. 

Ø      Next week the plan is to have the concrete poured around the building and a pad in front of the playground, moving the pavilion so parents can sit close to the kids playing on the playground. 

Ø      There were also four more loads of red infield mix delivered.  This will be spread out over the big field because it was holding water.  Hopefully, that will solve that problem. 

Ø      We’ve been answering questions from the State for the last three reimbursements.  We have two of the three resolved and the money should be deposited very soon. 

Ø      Stoney has been working on the wiring.  Chief Stone then gave the council an update on his progress.   

Ordinance #06-01 – STC Cable – Vince King – Second Reading

            Councilman Terry Zumbro made the motion to defer this issue to next month’s meeting.  He has been doing research and checking on other options.  Councilman Harold Vincion seconded the motion.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.  

NEW BUSINESS

Harpeth River Watershed Association – John McFadden

            Mr. John McFadden addressed the Council and thanked them for the opportunity to come and speak to them.  Melissa handed out packets to all.  Included in the packets was information on the current issues the Harpeth River Watershed Association  has going on right now involving Eagleville and surrounding areas.  There was also an application included to become a member of the Harpeth River Watershed Association.  After much discussion the Mayor and the Council thanked Mr. McFadden and Mrs. Buchanan for the information and their time to the community.   

Septic Tank Bids

            Mayor Barham stated that we had only received one sealed bid.  He handed the bid to Vice-Mayor Ronnie Hill to open.  It was from Jones Septic Service in the amount of $165.00 per pump.  Vice-Mayor Ronnie Hill made the motion to approve the bid from Jones Septic Service.  Councilman Harold Vincion seconded the motion.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.  

Annexation Ordinance #06-02 – First Reading – Planning Commission

            The Planning Commission’s Secretary, Councilman Harold Vincion, presented the Council with an ordinance to annex the right-of-ways on all the Federal and State Roads in our Urban Growth Boundary.  It would take in all State, Highways 99 and 269,  and Federal, Highway 41-A, going through Eagleville.  Councilman Vincion explained that this in no way raises anyone’s property tax.  The benefit of annexing the roads is if someone wishes to have their property annexed into the town along these main roads, it would make the process a lot simpler.  A motion was made by Councilman Vincion from the Planning Commission to approve Annexation Ordinance #06-02.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously. 

FEMA Ordinance #06-03 – First Reading

Mayor Barham presented the Council with FEMA Ordinance #06-03.  Mayor Barham and Bo Logan, City Planner, explained that by law we have to submit this ordinance about establishing areas of certain flood hazards. 

A motion was made from the Planning Commission to approve the Annexation Ordinance #06-02.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.  

Resolution #R-06-08 – Grant Reapplication for Sidewalks

            Mayor Barham stated that he met with Tonya Blades last week and was informed that the Council needs to have another Resolution re-applying for the sidewalk grant. 

Councilman Terry Zumbro made the motion to approve Resolution #R-06-08 – Grant Reapplication for Sidewalks.  Councilman David Rigsby seconded the motion.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously.  

Business Taxes Classifications – Greg Buchanan

            Councilman Buchanan stated that he noticed a couple of problems with the business classifications.  He wants the Council to go over the classifications to see who should have a business license and who shouldn’t.  He stated that he noticed his County and his City taxes were six months apart.  He talked with Michelle and the County regarding this.  They did get it straightened out where it is due at the same time.  He wanted to look at the new classifications and maybe adopt what the County does.  Mayor Barham made a suggestion to look at this and make a recommendation on this issue.  Attorney Greg Reed stated that the list that Eagleville currently uses was done in the 70’s or 80’s.  He suggested reviewing the classifications, but also stated that the State Classifications are in the code book.   

COUNCIL BOARD, SPECIAL REPORTS

Police Board Report

            Chief Stone reported that the Neighborhood Watch meeting went very well.  There will be signs put up around town in the next few weeks.   

Ø      Camera Surveillance

Chief Stone reported the quote had expired.  It was only good for three days.  A few business owners have been contacted regarding donations and there were mixed reviews on this issue. 

Ø      Fall Festival

Chief Stone stated that he had asked a few Rutherford County Deputies to help that day. 

Ø      Eagleville Sign

            Chief Stone stated that he could try to fix it and put it back up.  Mayor Barham stated that he had talked to Larry McElroy with CUD and they are not finished with the lines on that end of town.  When they are done, he is going to talk to us regarding a new sign.   

Fire Board Report

None.  

Beautification Report

Ø      Councilman Greg Buchanan reminded everyone of the Eagleville Fall Festival on October 7, 2006.  They are receiving so many requests from venders that they are looking into using the field next to Henry’s Store. 

Ø      Regarding the cash prizes awarded at the Festival, Michelle stated that she has talked with Ralph Cross and Mary Ann Underwood.  They both approved of writing Melissa Buchanan a check in the amount of all the cash prizes.  She would cash the check and give out the money to the winners.  She will then have to turn in signed receipts and amounts totaling the amount of the check.  Everyone was in agreement. 

Ø      Councilman Buchanan asked about the budget for the Beautification Committee.  He also asked about a separate checking account for the Beautification Committee.  Mayor Barham stated that issue had been investigated before and it was viewed negatively by the accountant and auditor. 

Ø      Councilman Buchanan raised the question of the Beautification Committee having the use of the Town owned ambulance.  There was no obligation to this. 

Ø      Councilman Smitty raised concern the children crossing the street.  He asked what the deputies’ role would be.  Chief Stone stated they are there for security.   

MAYOR’S CLOSING REMARKS

Ø      Michelle told the Council that next week everyone would be getting their property tax bills.  She stated they are in an envelope this year instead of a post card.  If taxes are paid through the mortgage company, taxpayers would not receive a notice. 

Ø      Mayor Barham thanked everyone for all the good work. 

ADJOURNMENT

With no further business to discuss, Mayor Barham asked for a motion to adjourn.  Councilman Smitty made the motion to adjourn and Councilman David Rigsby seconded.  By unanimous vote, the meeting was adjourned at 7:58 p.m.  The motion was passed by a unanimous “Aye” vote.
