MINUTES OF A CALLED SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

March 22, 2007 

The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on  March 22, 2007, in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham.   

ROLL CALL

            A roll call was taken by City Recorder Michelle Bennett.  All members were present except Councilman Greg Buchanan (who arrived at 7:05 p.m.) and Councilman David Rigsby.   

INVOCATION

Moment of Silence.   

PLEDGE OF ALLEGIANCE

Campbell & Mitchell Turner led the Pledge of Allegiance to the flag. 

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

RECESS CITY COUNCIL MEETING

Mayor Barham recessed the City Council meeting.  

CALL TO ORDER PUBLIC HEARING

            Mayor Barham called to order a public hearing and asked for any comments on the following:

Ø      Ordinance #07-02 – Budget Reconciliation – Second Reading

No Comment.

Ø      Ordinance #07-03 – Code of Ethics – Second Reading

No Comment.

ADJOURNMENT OF PUBLIC HEARING

With no comments being offered, Mayor Barham adjourned the public hearing.

CALL BACK TO ORDER CITY COUNCIL MEETING

Mayor Barham called the City Council meeting back to order.   

CITIZEN’S INPUT

            None.

APPROVAL OF MINUTES

            Mayor Barham asked for a motion to approve the February 22, 2007.  Councilman Terry Zumbro made the motion with Councilman Harold Vincion seconding.  A roll call vote was administered by Michelle Bennett and the motion passed 4-0.  Councilman Rigsby and Buchanan were not present.  

FINANCIAL STATEMENT

            Mayor Barham asked for a motion to adopt the Financial Statement.  Councilman Harold Vincion moved and Vice-Mayor Ronnie Hill seconded.  After discussion, a roll call vote was administered by Michelle Bennett and the motion passed 4-0.  Councilman Rigsby and Buchanan were not present.  

ADDITIONS / DELETIONS TO AGENDA

            The park update and the Coffey annexation were added to the agenda under Old Business.   

OLD BUSINESS

Park Update

1.      Vice-Mayor Ronnie Hill stated that the bleachers are in.

2.      Car show will be held June 2nd, with a rain date of June 9th.  There will be 63 trophies presented.  Sponsors are needed again this year. 

3.      Vice-Mayor Hill will be setting a date for the Grand Opening and dedication of the ball fields maybe the first weekend in May.  They are working on the signs, which may be bronze plates. 

4.      Jeff is taking care of all the schedules with the laptop that Harold and Linda Vincion donated. 

5.      Banners and signs will be sold for $350.00 for advertising. 

6.      More fill dirt was brought in to raise the parking lot thanks Williamson County (Civil Construction). 

7.      The City and Park grant was audited by the state and the report came back perfect. 

8.      There was a scope change sent into the State to request money for the playground by reducing other funded items in the grant, for example administration. 

9.      Vice-Mayor Hill stated that $2,500 was transferred out of the general fund to the park fund

10.  Councilman Smitty asked Vice-Mayor Hill about paving the road.  He stated that this has been discussed with the county and they are perusing this idea further.  It may be at the end of summer. 

11.  There were a total of 90 children that signed up to play ball this season.  The City received $10 per child for a total of $900.  This money will be used to buy items for the concession stand. 

Ordinance #07-02 – Budget Reconciliation – Second Reading

Mayor Barham asked for a motion to approve Ordinance #07-02 – Budget Reconciliation on second reading.  Vice-Mayor Ronnie Hill made the motion to approve and Councilman Harold Vincion seconded.  A roll call vote was administered by Michelle Bennett and the motion passed 5-0. Councilman Rigsby was not present.   

Ordinance #07-03 – Code of Ethics – Second Reading

Councilman Terry Zumbro made the motion to approve Ordinance #07-03 – Code of Ethics on second reading and Vice-Mayor Ronnie Hill seconded.  There was no discussion.  A roll call vote was administered by Michelle Bennett and the motion passed 5-0. Councilman Rigsby was not present. 

Police Department update – Mayor Barham

            Mayor Barham stated that there had been a meeting with two investigators from the P.O.S.T. Commission and that the required information that they needed was duplicated by Michelle and given to them.  There is nothing further to report at this time.  He also stated that he had had continuing conversations with Sheriff Truman Jones, and that under the current circumstances; the county would do what’s best to provide protection for Eagleville residents.  He indicated that it could be several weeks before any further information would be available. 

Business Taxes – Attorney Travis M. Lampley

            Mayor Barham asked attorney Lampley to address any findings that he might have concerning procedures and time frames for paying business taxes.  Attorney Lampley stated that he had done some research on this topic and was not completely ready to present a report. 

Coffey Property Annexation – Councilman M. A. Smitty

            Councilman Smitty asked about the third and final reading on the Coffey property annexation.  Mayor Barham stated that due to the time frame for notification of a public hearing, this would have to be delayed one month.   

NEW BUSINESS

Ø      Planning Commission Recommendation – Zoning Change

Councilman Harold Vincion told the Council that Mr. Denny Tittle had come before the Planning Commission requesting his property at 1027 N. Main Street be rezoned from residential to commercial.  Mr. Denny Tittle then addressed the council and stated that someday he may desire to have a business on this property.  After a brief discussion the Council voted unanimously to approve this zoning request on first reading.   

COUNCIL BOARD, SPECIAL REPORTS

Fire Board Report

Ø      Interim Fire Chief, Tony Jackson, stated there was no report.   

Beautification Report

Ø      Mayor Barham stated that everyone had received a copy of the letter from Councilman Buchanan resigning from the Beautification Committee and Activities committee effective immediately. 

Ø      Mayor Barham reminded everyone of the upcoming Easter Egg Hunt.  

MAYOR’S CLOSING REMARKS

Ø      In closing, Mayor Barham congratulated Councilman Greg Buchanan and wife Melissa on the birth of their baby girl, Adlar Alise.   

ADJOURNMENT

With no further business to discuss, Mayor Barham asked for a motion to adjourn.  Councilman Smitty made the motion to adjourn and Councilman Greg Buchanan seconded.  By unanimous vote, the meeting was adjourned at 7:35 p.m.   

RECONVENING OF COUNCIL MEETING

            Mayor Barham reconvened the council meeting with general consent from the Council.  He asked the attorney to speak to the issue of a complaint that was filed regarding Councilman Terry Zumbro and payment of his business taxes. 

            Attorney Lampley stated that this issue was moot and there was no need for discussion.  The previous attorney had already ruled on this matter and Attorney Lampley was in agreement.  It was noted that Councilman Zumbro had paid all requested business taxes with penalties and was current according to City Recorder Michelle Bennett.   

ADJOURNMENT

With no further business to discuss, Mayor Barham asked for a motion to adjourn.  Councilman Harold Vincion made the motion to adjourn and Councilman Terry Zumbro seconded.  By unanimous vote, the meeting was adjourned at 7:45 p.m.
