MINUTES OF A CALLED SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

April 26, 2007 

The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on  April 26, 2007, in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham.   

ROLL CALL

            A roll call was taken by City Recorder Michelle Bennett.  All members were present.   

INVOCATION

Pastor David Martin delivered the invocation.   

PLEDGE OF ALLEGIANCE

Tony Jackson led the Pledge of Allegiance to the flag. 

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

SPECIAL RECOGNITION

Ø      Recognize Eagleville School Retiring Teacher

Mayor Barham recognized retiring teacher, Marion Joyce.  He presented

her with a plaque from the City and thanked her for her service.   

Ø      Recognize Eagleville School Teachers of the Year

        Eagleville School had three teachers of the year.  Renay Anderson, elementary; Brent Meadows, middle school; and high school and overall teacher of the year, Retika Patterson.  Mrs. Retika Patterson was present and Mayor Barham awarded her with a plaque from the City and congratulated her on this great accomplishment.  Each teacher thanked the Council for the recognition and they appreciated the opportunity to teach at Eagleville school.   

ADOPTION OF AGENDA

    Mayor Barham asked for a motion to adopt the Agenda as written.  Councilman Smitty made the motion and Councilman Zumbro seconded.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.  

RECESS CITY COUNCIL MEETING

Mayor Barham recessed the City Council meeting.  

CALL TO ORDER PUBLIC HEARING

            Mayor Barham called to order a public hearing and asked for any comments on the following:

Ø      Ordinance #07-01 – Coffey Annexation – Third and Final Reading

No Comment.

Ø      Ordinance #07-04 – Zoning Change – Second Reading

No Comment.

ADJOURNMENT OF PUBLIC HEARING

With no comments being offered, Mayor Barham adjourned the public hearing.  

CALL BACK TO ORDER CITY COUNCIL MEETING

Mayor Barham called the City Council meeting back to order.   

CITIZEN’S INPUT

Ø      Jon T. Harris representing Barge, Waggoner, Sumner & Cannon, Inc. told the Council that he would offer any services if the City needed them. 

Ø      Councilman Terry Zumbro stated that the Eagleville Times had written a story on him regarding his business taxes, which he has paid and is current.  He stated that he had done some checking of his own and that the Eagleville Times should have purchased a business license from the City during the time that it was only a monthly publication.  He stated that the Eagleville Times also owed personal property tax for that period of time to the City and the County. 

Ø      Councilman Zumbro also said that Mr. David Turner did not acquire a business license from Rutherford County for his ATV business he had last year.  Rutherford County has no record of his business on file anywhere. 

Ø      Keith Carey spoke on behalf of Harpeth River Watershed Association.  He stated that a Citizens Action Committee needed to be formed. 

Ø      David Turner stated that his business sold ATV’s for the company Highlander and didn’t need a business license. The name of his company was Affordable Equipment.  Mr. Turner also said he would like to see Industrial Dr. changed to Park Ave.

Ø      Mr. Turner recommended getting rid of some city vehicles.     

APPROVAL OF MINUTES

            Mayor Barham asked for a motion to approve the March, 2007 minutes.  Councilman Terry Zumbro made the motion with Councilman M.A. Smitty seconding.  A roll call vote was administered by Michelle Bennett and the motion passed 5-1 with Councilman Greg Buchanan voting no.   

FINANCIAL STATEMENT

            Mayor Barham asked for a motion to adopt the Financial Statement.  Councilman M. A. Smitty moved and Councilman Terry Zumbro seconded.  After a brief discussion regarding the Park, Chamber of Commerce and Verizon, a roll call vote was administered by Michelle Bennett and the motion passed unanimously.   

OLD BUSINESS

Park Update

1.      Vice-Mayor Ronnie Hill told the Council that the dedication of the fields and flag pole would be held on May 19th at 1:00 p.m.  The flag pole was donated by the Patterson Family. 

2.      The scope of the grant has been changed.  This was needed to add the playground equipment to the grant.

3.      Vice-Mayor Hill also stated that they are expecting a reimbursement on tomorrow, and that another $2,500 had been moved from the general fund account to the park fund. 

4.      There will be another car show this year held on June 2nd.  The Park Board is asking for volunteers to work and donations for trophies. 

5.      Stoney has fixed the breakers at the concession stand.

6.      Smitty has donated 7 picnic tables with a total cost of $5,600.

7.      There will be a Park Board Meeting this Sunday at 2:00 at the concession stand. 

8.      He also said that Stoney is just about done with all the electrical work.  Stoney did donate $3,000 to the new park. 

9.      Vice-Mayor Hill said that he thinks changing the name of the road to Park Ave. was a good idea. 

10.  Vice-Mayor Hill stated that there would be several fundraisers this summer for the park.   

Ordinance #07-01 – Coffey Annexation – Third and Final Reading

Mayor Barham asked for a motion to approve Ordinance #07-01 – Coffey Annexation on Third and Final Reading.  Councilman M. A. Smitty made the motion to approve and Councilman Harold Vincion seconded.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0. 

Ordinance #07-02 – Budget Reconciliation – Third and Final Reading

Mayor Barham asked for a motion to approve Ordinance #07-02 – Budget Reconciliation on Third and Final Reading.  Councilman Terry Zumbro made the motion to approve and Vice-Mayor Ronnie Hill seconded.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously.   

Ordinance #07-03 – Code of Ethics – Third and Final Reading

Vice-Mayor Ronnie Hill made the motion to approve Ordinance #07-03 – Code of Ethics on Third and Final Reading and Councilman Terry Zumbro seconded.  There was no discussion.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.   

Ordinance #07-04 – Tittle Zoning Change – Second Reading

Councilman Smitty made the motion to approve Ordinance #07-04 – Tittle Zoning Change on Second Reading and Councilman Greg Buchanan seconded.  There was no discussion.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously.   

Police Department update – Mayor Barham

            Mayor Barham told the council that he had talked with the POST Commission and the investigation was closed.  He had a meeting with Stoney to discuss this issue and Stoney told him that he decided to retire.  Mayor Barham suggested paying him for his three weeks vacation and back-pay from February 22, 2007.  There was much discussion about receiving a letter from the POST confirming the status of the investigation. 

Councilman Vincion made a motion to defer until we have it in writing from Mr. Brian Grisham, POST Commission, regarding the status of the investigation.  Councilman Greg Buchanan seconded the motion.  A roll call vote was administered by Michelle Bennett and the motion passed 5-1 with Councilman Smitty voting no.

Councilman Vincion made a motion to defer back payment for Everett Stone until the letter was received from the POST.  Councilman Greg Buchanan seconded the motion. Councilman M. A. Smitty then made an amendment to the motion to pay Everett Stone for his three weeks vacation time.  Councilman Terry Zumbro seconded the motion.  After discussion Councilman Smitty rescinded his motion.  

Councilman David Rigsby made an amendment to the motion to pay Everett Stone for his three weeks vacation time.  Councilman Terry Zumbro seconded the motion.  A roll call vote was administered by Michelle Bennett and the amendment to the motion passed 4-3 with Councilman Buchanan, Councilman Smitty, and Vice-Mayor Hill voting no.  Councilman Rigsby, Councilman Vincion, Councilman Zumbro, and Mayor Barham voted yes.

Mayor Barham then asked Michelle to read the motion as amended to the council on a roll call vote, the motion passed 5-1 with Councilman Smitty voting no.   

NEW BUSINESS

Ø      Resolution #R-07-01 Plan of Service for the Annexation of the Coffey Property

Mayor Barham asked for a motion to approve Resolution #R07-01 Plan of Service for the Annexation of the Coffey Property.  Councilman Harold Vincion made the motion and Councilman M. A. Smitty seconded.  There was no discussion.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0. 

COUNCIL BOARD, SPECIAL REPORTS

Fire Board Report

Ø      Interim Fire Chief, Tony Jackson, stated there was no report.   

Ø      Mayor Barham stated that they had received applications in for Fire Chief and the Fire Board will be meeting regarding these applications. 

Beautification Report

Ø      Mayor Barham thanked the Beautification Committee for a great Easter Egg Hunt.  

MAYOR’S CLOSING REMARKS

Ø      In closing, Mayor Barham thanked everyone for coming to the meeting.  He gave special recognition again to those teachers who were honored from Eagleville School.   

ADJOURNMENT

With no further business to discuss, Mayor Barham asked for a motion to adjourn.  Councilman Smitty made the motion to adjourn and Councilman Greg Buchanan seconded.  By unanimous vote, the meeting was adjourned at 8:00 p.m.
