MINUTES OF A CALLED SESSIONOF THE COUNCIL OF THE TOWN OF The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on May 24, 2007, in Eagleville City Hall with Mayor Nolan S. CALL TO ORDER The meeting was Called to Order by Mayor Nolan Barham. ROLL CALL A roll call was taken by City Recorder Michelle Bennett. All members were present. INVOCATION Moment of silence. PLEDGE OF ALLEGIANCE Brittany Patterson led the Pledge of Allegiance to the flag. MAYOR'S WELCOME Mayor Barham welcomed everyone to the City Council meeting. He also asked everyone to remember the three previous Mayors who were having health-related issues. ADOPTION OF AGENDA Mayor Barham asked for a motion to adopt the Agenda as written. Councilman Vincion made the motion and Councilman Zumbro seconded. Vice-Mayor Ronnie Hill made an amendment to the motion to discuss overtime pay after the ordinance on the budget. Councilman Harold Vincion seconded the amendment to the motion. A roll call vote was administered by Michelle Bennett and the amendment passed 6-0. Mayor Barham asked Michelle for a roll call for the adoption of the amended Agenda. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. CITIZEN’S INPUT During Citizens Input Donna Jensen spoke about the budget. Phil Williams said he would like the Citizens Input moved to the end of the meeting. Mr. Leslie Kelley asked the Council if the City Recorder set her own salary or did the Council. He was under the impression that the City Council set and voted on the City Recorder’s salary. He also mentioned how other companies offer benefits to their full time employees. Melissa Buchanan voiced her concerns on the budget and the City Recorder. Councilman Smitty spoke as a citizen and stated that the proper procedure is for Citizens Input to be at the beginning of the meeting so that any citizen concern would be known by the Council. APPROVAL OF MINUTES Mayor Barham asked for a motion to approve the April, 2007 minutes. Councilman Terry Zumbro made the motion to approve the minutes with corrections. The corrections were the correct name of David Turner’s business and the motion and second on the Coffey annexation. Councilman David Rigsby seconded the motion. A roll call vote was administered by Michelle Bennett and the motion passed 5-1 with Councilman Greg Buchanan voting no. FINANCIAL STATEMENT Mayor Barham asked for a motion to adopt the Financial Statement. Councilman M. A. Smitty moved and Vice-Mayor Hill seconded. After a brief discussion regarding Horton Utility District, the City Planner salary and Wal-Mart, a roll call vote was administered by Michelle Bennett and the motion passed 5-1 with Councilman Greg Buchanan voting no. OLD BUSINESS Park Update 1. Before this report there were many thanks for the work that had been done at Eagleville Park and for the leadership of Vice-Mayor Hill and Jeff Mooneyham. 2. Vice-Mayor Ronnie Hill told the Council that the City of Eagleville has put $5,000 cash into the park so far out of the General Fund account of $10,000 for this purpose. 3. Ronnie Hill stated that the Dedication Ceremony went very well. The three fields and the flagpole were dedicated. Vice-Mayor Hill talked with County Mayor about getting the road paved. He told Vice-Mayor Hill that he would look into it. He also stated that County Mayor Burgess donated $5,000 of his personal funds to the park. 4. Fencing has been ordered to go around the playground and awnings have been ordered to go over the concession stand windows. 5. The car show will be June 2nd from 8:00 a.m. – 3:00 p.m. The Tennessean came to take pictures and will be advertising the car show this week. 6. Vice-Mayor Hill talked about the walking trail and the picnic pavilion. He asked Mayor Barham about the status of the Greenway Grant. Vice-Mayor Hill mentioned that Alan Farley had stated that it could be incorporated into the park and the Park could actually become the trailhead for the Greenway. Mayor Barham stated that he will be meeting with Tonya Blades regarding this issue soon. 7. Councilman Smitty asked about the new name of the road. Vice-Mayor Hill stated that the Park Board voted on Park Ave, but the Council will have to vote on the renaming. 8. Vice-Mayor Hill and the Park Board made the recommendation renaming Industrial Blvd to Park Ave. After discussion a roll call vote was administered by Michelle Bennett and the motion passed 6-0. 9. As a comment, Councilman Smitty talked to Mr. Payne with the Rutherford County DOT. He stated that the bid for the new road is August 16th or 17th, and that we should see construction on the new road this year. 10. Greg Buchanan stated that he spoke with someone who cuts grass for a ballpark in Franklin. This person cuts the ball-fields twice a week. Councilman Buchanan asked Vice-Mayor Hill if this is something we should consider, and he responded that ours is being cut twice a week now. Ordinance #07-04 – Tittle Zoning Change – Third and Final Reading Councilman Smitty made the motion to approve Ordinance #07-04 – Tittle Zoning Change - Third and Final Reading, and Councilman Terry Zumbro seconded. There was no discussion. A roll call vote was administered by Michelle Bennett and the motion passed unanimously. Police Department update – Mayor Barham Ø Mayor Barham told the Council that he and Sheriff Jones had been in constant contact and they will do their best to continue patrolling Eagleville until we deem otherwise. They will be meeting to discuss options about potential future coverage. There will be other proposals to consider at a future meeting or work session. He thanked the two officers at the meeting. Ø Councilman Buchanan asked if we were going to have a Police Board. Mayor Barham told him no. Ø Councilman Smitty stated that he thought Rutherford County was doing a fine job, but we don’t need to forget we need to allocate more money in our budget for our own police officer. Business Tax Procedure – Attorney Travis Lampley Attorney Travis Lampley stated that he had been reviewing this issue and going through the Charter on tax procedures. It refers back to ordinances and resolutions that were passed. He needs to review these. Councilman Smitty stated that he felt whoever the tax collector is needs a procedure of what happens after 30 days, 60 days, etc. before the City takes action on property. NEW BUSINESS Ø Thurman Carey Group – Keith Carey Mayor Barham recognized Keith Carey. Mr. Carey presented the Council with copies of a proposal to obtain an official endorsement and working relationship with the City Council and Mayor to explore several options to deal with the environmental hazards caused by the failing septic systems of Eagleville. His proposal contained several goals, processes and resources which are available to help this community. A copy of the proposal is on file at City Hall with the minutes. Mayor Barham suggested to the Council to look over this proposal and he will put it on the Agenda for the June meeting. After discussion Mayor Barham thanked Mr. Carey. Ø Recommendation from Planning Commission – Property Rezoning The Planning Commission made the motion for the City Council to approve Ordinance #07-06 Holt Property Rezoning on first reading. After discussion a roll call vote was administered by Michelle Bennett and the motion passed 6-0. Mayor Barham thanked Councilman Smitty for getting the rezoning signs ordered and delivered to City Hall. Ø Ordinance #07-05 Budget 2007-2008 First Reading Councilman Harold Vincion made the motion to approve Ordinance #07-05 Budget 2007-2008 on the first reading with the correction of the property tax rate on the Ordinance and to have another budget work session meeting on June 18th. Councilman David Rigsby seconded the motion. After much discussion there were two clarifications made. Councilman Rigsby noted that the tax increase was not 5%, but $.05. Councilman Smitty pointed out that the Fire Department pay is a separate entity paid by the County, not by the City, and should not be considered a part of the City Recorder’s salary. A roll call vote was administered by Michelle Bennett and the motion passed 4-3, with Vice-Mayor Hill, Councilmen Smitty & Buchanan voting no. Councilmen Rigsby, Vincion, Zumbro and Mayor Barham voting yes. Ø Projected Overtime Pay Vice-Mayor Hill stated that since there was no more overtime pay, the Mayor could continue to the next item. COUNCIL BOARD, SPECIAL REPORTS Fire Board Report Ø Councilman Vincion told the Council that the Fire Board recommended David Martin as the new Fire Chief beginning June 1, 2007. After discussion a roll call vote was administered by Michelle Bennett and the motion passed unanimously. Beautification Report Ø Mayor Barham stated that he would be meeting with the Beautification Committee. Ø Councilman Buchanan asked about the status on the sign. Mayor Barham responded that pictures of the damaged sign have been taken and sent to The Very Idea. They will make recommendations on how, or if, it can be fixed. The second option is having Ed Wettig fix the sign. Police Department Report Ø Everett Stone’s Retirement Letter o Mayor Barham stated that the Council had asked to delay the final decision on Everett Stone until we received a letter from the POST. He stated that the Council received a copy of the letter from Brian along with Everett Stone’s retirement letter, effective April 27, 2007. He asked for a motion to accept Everett Stone’s retirement letter. Councilman Terry Zumbro made the motion and Councilman David Rigsby seconded. A roll call vote was administered by Michelle Bennett and the motion passed 6-0. Ø Everett Stone’s Back-Pay o Mayor Barham and the Council discussed Everett Stone’s back-pay. The time period was February 23, 2007-April 27, 2007. Councilman M. A. Smitty made the motion to approve $2,617.07 based on a 20-hour work week. Councilman David Rigsby seconded the motion. After much discussion, a roll call vote was administered by Michelle Bennett and the motion passed 5-1 with Councilman Buchanan voting no. MAYOR’S CLOSING REMARKS Ø Recognize Everett Stone o Mayor Barham stated that Stoney has worked for four mayors and thanked him for all of his years of service. He told the Council and the citizens that it has been a tremendous working relationship. He related that in January, Stoney had expressed his retirement at the end of June. He told Stoney that we were here tonight to honor and recognize him. He stated that a lot of people did not know the influence he had on this community, and that he is a legend here. The Mayor recalled a few events which showed the devotion Stoney had for Eagleville… 1.) The day that all of the TV cameras were in Eagleville, a lady had to stop in front of City Hall with a heart condition. Stoney rushed out to help her, and her remarks were, “Thank you for being here Stoney; you’ve always been there when we needed you.” 2.) The Sheriff’s Department called about a gentleman that was intoxicated and Stoney was waiting on him at the traffic light and apprehended him. Stoney was knocked across the hood of the car and could have been very critically injured. He took care of the suspect until Rutherford County Patrol arrived. 3.) In December or January Stoney was honored and recognized for the heroism that he showed trying to save a young man’s life. He did all that he could to save his life and the young man was life-flighted to Chattanooga. His family in Indiana sent word thanking Stoney and the others for allowing them the opportunity of being with him a short while before he died. 4.) Mayor Barham indicated that this community is greatly indebted to Stone for his 24/7 on call duty. Mayor Barham stated that he personally appreciated his dedication. o Councilman Terry Zumbro stated that he talked to several police officers about Stoney. One of the greatest compliments he can give Stoney was that other police officers said they would rather have Stoney at their back on any call than anybody they knew. o Vice-Mayor Ronnie Hill said that Stoney donated $3,000 worth of electrical work at the park, and that he has always liked Stoney’s demeanor with this town and Stoney would be missed. He is cool, but calm and collected. o Mayor Barham asked Michelle to present him with a plaque from himself, the City Council and staff for his 20+ years of service and commitment to the Eagleville Police Department. Councilman Smitty then led the Council and citizens with a standing round of applause for Stoney. o Everett Stone stated that he hadn’t regretted anytime he had been in Eagleville. He plans on continuing to live in Eagleville. He thanked Mayor Barham, the Council and Staff for the wonderful working relationship and this recognition. ADJOURNMENT With no further business to discuss, Mayor Barham asked for a motion to adjourn. Councilman Smitty made the motion to adjourn and Councilman Greg Buchanan seconded. By unanimous vote, the meeting was adjourned at 8:36 p.m.
