MINUTES OF A CALLED SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

June 21, 2007 

The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on  June 21, 2007, in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham.   

ROLL CALL

           A roll call was taken by City Recorder Michelle Bennett.  All members were present.   

INVOCATION

Moment of silence. 

PLEDGE OF ALLEGIANCE

David Martin, Fire Chief, led the Pledge of Allegiance to the flag. 

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting. He also asked everyone to remember the three previous Mayors who were having health-related issues and a family in Eagleville that was going through a hard time.   

RECESS CITY COUNCIL MEETING

Mayor Barham recessed the City Council meeting.  

CALL TO ORDER PUBLIC HEARING

            Mayor Barham called to order a public hearing and asked for any comments on the following:  Ordinance #07-05 – Budget 2007-2008 – Second Reading and Ordinance #07-06 – Holt Rezoning – Second Reading. 

Ø      Donna Jensen spoke about the budget and the tax increase. 

Ø      Mrs. Cornelia Elmore spoke about former Chief Everett Stone and the 2007-2008 Budget. 

Ø      Davina Thompkins asked the City Council to generate more money through the New City Park and the concession stand.  She stated she would have been more than happy to volunteer her time. 

Ø      Bridget Fitzgerald stated that she was not in agreement with a benefits package.   

ADJOURNMENT OF PUBLIC HEARING

After all comments were heard, Mayor Barham adjourned the public hearing.  

CALL BACK TO ORDER CITY COUNCIL MEETING

Mayor Barham called the City Council meeting back to order.   

ADOPTION OF AGENDA

Mayor Barham asked for a motion to adopt the Agenda as written.  Councilman Vincion made the motion and Councilman Zumbro seconded.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously. 

CITIZEN’S INPUT

Mr. Phil Williams stated his concern was the City running with no police protection and what are the citizens getting for their tax money.  He also had concerns with the benefits package and the Fire Department administrative pay. 

Keith Carey spoke again regarding the Thurman Carey Group proposal.  He stated that he was hoping that they would get an official endorsement to go ahead with his proposal. 

Fire Chief David Martin stated that it was the former Chief told him that all reports were caught up and that it was his responsibility to do the reports.  He also stated Michelle does all the accounting and administrative work for the Fire Department.  None of the money is paid to her from the City; it is paid by the County. 

APPROVAL OF MINUTES

            Mayor Barham asked for a motion to approve the May, 2007 minutes.  After discussion from Councilman Greg Buchanan and Vice-Mayor Ronnie Hill, Councilman Terry Zumbro made the motion to approve the minutes and Councilman Harold Vincion seconded.  After discussion a roll call vote was administered by Michelle Bennett and the motion passed 4-2, with Councilman Buchanan and Vice-Mayor Hill voting “No.”  

FINANCIAL STATEMENT

            Mayor Barham asked for a motion to adopt the Financial Statement.  Vice-Mayor Ronnie Hill made a motion and Councilman M. A. Smitty seconded.  No discussion.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously. 

OLD BUSINESS

Park Update

1.      Vice-Mayor Ronnie Hill stated the car show was again a $6,500 success. 

2.      We are in the last phases of the grant.  He said that we would not be receiving any more reimbursements from the State until the park was completed. 

3.      There were awnings put up around the windows of the concession stand. 

4.      Vice-Mayor Ronnie Hill made the motion to pay Jeff Mooneyham $500.00 for working the concession stand.  He stated that Jeff and his wife Kelly worked all day Saturday and four nights this week for a total of 15 games.  Councilman David Rigsby seconded the motion.  After discussion a roll call vote was administered by Michelle Bennett and the motion passed unanimously.  

Business Tax Procedure Update

            Mayor Barham stated our attorney had been in court and could not make it tonight.  This would be on the agenda at the next regular meeting.   

Ordinance #07-05 – Budget 2007-2008 – Second Reading

Mayor Barham and Michelle informed the Council of the updated figures on the 2007-2008 budget work-sheet.  Councilman Terry Zumbro made the motion to approve the 2007-2008 Budget on the second reading with Councilman David Rigsby seconding.  Councilman Harold Vincion made a motion to table the second reading until after another work session.  There was no second, therefore, the motion died.  After discussion a roll call vote was administered by Michelle Bennett and the motion passed 4-3, with Mayor Barham, Councilman David Rigsby, Councilman Harold Vincion, and Councilman Terry Zumbro voting “Yes,” and Councilman Greg Buchanan, Councilman M. A. Smitty, and Vice-Mayor Hill voting “No.”   

Ordinance #07-06 – Holt Rezoning – Second Reading

Councilman Harold Vincion made the motion to approve the Holt Rezoning and Councilman Terry Zumbro seconded.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously. 

Thurman Carey Group Proposal

Vice-Mayor Ronnie Hill made the motion to approve the endorsement for Council to support the formation of a committee that would include members of the Council and the community to research options both in funding and technical resources to deal with wastewater issues with Eagleville.  Councilman Greg Buchanan seconded the motion.              Councilman Smitty made a motion to amend the motion that when a group is formed the Mayor would serve as Chairman.  There was no second, therefore, the motion died. 

After discussion, a roll call vote was administered by Michelle Bennett and the motion passed 6-0.  

NEW BUSINESS

Ø      Recommendation for Planning Commission

Mayor Barham told the Council that it was time to vote on Councilman Harold Vincion’s three-year term to the Planning Commission.  Vice-Mayor Hill made the motion that Councilman Harold Vincion serve another three-year term.  Councilman Terry Zumbro seconded the motion.  A roll call vote was administered by Michelle Bennett and the motion passed 5-0-1, with Councilman Harold Vincion abstaining.  Mayor Barham stated that the other member position for a three-year term is appointed by the Mayor by State Law.  Mayor Barham appointed Bobby Turner.  These two members will serve until 2010. 

Ø      CD Renewals

Mayor Barham told the Council that the CD’s will soon be maturing.  Councilman M. A. Smitty made the motion for Mayor Barham to get the best renewed rate possible on both CD’s.  Councilman David Rigsby seconded.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously.  

COUNCIL BOARD, SPECIAL REPORTS

Fire Board Report

Chief David Martin thanked the City of Eagleville for giving him the responsibility as Fire Chief and accepting him with open arms.  He did ask for a moment of silence and a time of prayer for the 9 fireman that fell in the fire in South Carolina.  Fire Chief David Martin then handed the Council a letter informing them of all the activities in June.  He then named the new positions of the firemen. 

Police Department Report

            Mayor Barham stated that he would be meeting with the sheriff very soon.  He also stated that he had written a letter to TDOT about putting a double yellow line starting at Tri-Wood and going South a half a mile.  He talked to the Sheriff’s Dept. about extra patrol during the time that there are ball games and practices. 

            Mayor Barham received a notice from TDOT that is worded differently than anything he had ever seen before.  He read the letter aloud to the Council and they all received a copy.  Basically, the letter stated that a bid process on Hwy 99 improvement will be held during the third quarter of the year. 

Beautification Report

      None.   

MAYOR’S CLOSING REMARKS

Ø      Mayor Barham reiterated that Michelle did take three days of her vacation days when she went to Las Vegas to represent the City of Eagleville as requested by the Rutherford County Chamber of Commerce. 

Ø      There will be no meeting in July.  The next regular scheduled meeting will be August 23rd.  This follows the pattern that we have done in the past. 

Ø      Councilman Greg Buchanan stated that he is selling his property in August.  They are purchasing property outside of city limits.  He will still own property inside city limits, which he thinks will still qualify him to hold his council seat. 

ADJOURNMENT

With no further business to discuss, Mayor Barham asked for a motion to adjourn.  Councilman Smitty made the motion to adjourn and Councilman Greg Buchanan seconded.  By unanimous vote, the meeting was adjourned at 8:18 p.m.
