MINUTES OF THE REGULAR SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE, TENNESSEE

January 27, 2004

  The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on January 27, 2004, in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

INVOCATION

            Councilman David Rigsby delivered the Invocation. 

PLEDGE OF ALLEGIANCE

            Councilwoman Debbie Ryan led the Pledge of Allegiance to the flag.

 MAYOR'S WELCOME

            Mayor Barham welcomed everyone to the City Council Meeting.   

CITIZEN’S INPUT

            Mr. John E. Turner stated that work had begun on the entrance to the parking lot to Las Fiestas as of Tuesday, January 27, 2004.  Mr. Turner will be contacting Ed Wettig for his help on marking off the parking spaces.  Mr. Turner thanked Mayor Barham for having the sidewalk cleared in front of Performax so everyone can now use the sidewalk to walk to the Post Office.  Mr. Turner welcomed Mr. M. A. Smitty and his Barber Shop to the Town of Eagleville. 

            Mr. Mike Bennett stated that he has lately noticed more and more traffic violations at night.  More speeders are coming through town, people are cutting through the Dairy Bar parking lot, loud vehicles, etc.  He would like to see another officer to help Chief Stone at night. 

           Mrs. Barbara Carlton seconded Mike Bennett’s statement.  She also has a lot of trouble with speeders recently. 

Mrs. Carlton also spoke in behalf of her father, Thomas Beard.  Mr. Beard would like to fill in some property on Cheatham Springs Road.  Mr. Beard stated he was informed by Dwayne Corbit, a county engineer, that he should put up a sign stating his intent and inform the Town of his intent to fill the land.  Mr. Beard’s purpose in attending the City Council meeting was to inform the City Council of his intent.    

 

Public Hearing

Mayor Barham recessed the City Council Meeting and called to order the Public Hearing on The Proposed Ordinance Enacting the Proposed New Municipal Code.  Two citizens asked to speak.  Mayor Barham recognized Mrs. Barbara Carlton and thanked her for sending in notice of her intent to speak ahead of time. 

Mrs. Carlton stated she has a lot of noise pollution with Holt’s Wastequip.  She lives directly across from them.  She suggested that the Town of Eagleville hire a Codes Officer to enforce the new codes.  She presented the Council with documentation of her past and present problems.  Mrs. Carlton sent a copy to Senator Larry Trail, who is helping her with this. 

         Mayor Barham recognized Mr. M. A. Smitty.  Mr. Smitty stated that he is glad Eagleville is getting new ordinances.  He appreciated the Town officials understanding about the temporary sign at his Barber Shop until his new, small sign is in place.  Mr. Smitty asked the Council to downsize the twenty-five (25) page sign ordinance.  He believes that is too much.   

             Mayor Barham called the Public Hearing to a close at 7:20 p.m., and called the City Council Meeting back to order at 7:21 p.m.

APPROVAL OF MINUTES

            The minutes were approved with a few non-substantive changes from Attorney Greg Reed. 

OLD BUSINESS

 Third and Final Reading of The Proposed Ordinance Enacting The Proposed New Municipal Code:

Attorney Greg Reed explained that the Third and Final Reading is an Ordinance,

which enacts the proposed Municipal Code.  The Town is trying to make the Codes more readily available to the citizens.  They have been available on the Eagleville website for more than 30 days and have also been in the local library and City Hall for residents to view.  Councilwoman Debbie Ryan stated that there had been about 100 hits on the Website since the codes were available.  Mayor Barham stated that if the City Council approved the Ordinance on the Third Reading, the new Municipal Code would take effect 15 days after passage, as stated in the Town Charter.  Councilman Harold Vincion moved to accept and Councilman Terry Zumbro seconded the motion. A roll call vote was administered by Sherry Marsalis and answered with a unanimous “Yes” from the Council, 5-0.

 NEW BUSINESS

Audit Proposal:

After proper advertising for proposals to conduct the Town’s 2003-2004 audit, one bid was submitted.  Mr. Joel Jobe, representing Jobe, Hasting, & Associates, spoke to the Council about the changes in governmental auditing and the conversion to the GASB system (General Accounting Standards Board).  The yearly audit for 2003-2004 would cost $9,750.00 under the proposal of Jobe, Hastings, & Associates, who are certified in Government Accounting Procedures.  Vice Mayor Ronnie Hill mentioned that the Town of Eagleville’s books would be handed over to Mr. Jobe’s firm after being corrected and organized by Hall, Davidson, & Associates.  Mr. Jobe stated that his firm’s proposal is based upon an hourly rate of $75.00, but the price could come down in the future if less work is required.  Councilwoman Debbie Ryan made the motion to accept the audit proposal.  Councilman David Rigsby seconded the motion.  A roll call vote was taken Sherry Marsalis and answered with a unanimous “Yes” from the Council, 5-0.

 

POLICE BOARD REPORT

            No report.

 

FIRE BOARD REPORT

             Fire Chief Joe Jackson informed the Council that of the four (4) vehicles in the fleet, only truck 4501 is running.  Truck 4502 is having an air dryer system problem, truck 4503 is out of service and does not meet NFP Standards, and 4504 is having electrical and diesel problems.  Chief Jackson also expressed concern that federal tax withholding is being taken out of the fire call checks.  The new procedure was instituted without notice to him or the department.    

 

BEAUTIFICATION COMMITTEE

Councilwoman Debbie Ryan told the Council that the pictures had been turned in to complete the funding of the trees for the new park.  She also stated that the new town limits entrance signs would be delivered in about two (2) weeks.  The Fire Department will be taking down the old signs.  The Fire Department will also change the banners around town very soon.

Election:

            Mrs. Linda Vincion and Mrs. Janie Zumbro are working with the Election Commission.  They will try to have the ballot for the April election in the February edition of the Eagleville Times. 

 Planning Commission:

            Mayor Barham told the Council that for the first time the Eagleville Planning Commission members have received the Certification in Planning Certificates.  The Planning Commission will begin another four hours of training for 2004. 

 Library Update:

Mayor Barham will meet with Laurel Best on Thursday morning beginning the process of going to the County Commission regarding the possibility of becoming a branch of Linebaugh Library. 

Next City Council Meeting:

            The next City Council Meeting will be held on Thursday, February 19, 2004, at

7:00.  Mayor Barham will be going to Washington as a delegate for the GNRC, and will be meeting with our Congressional delegation. 

 Minutes on Website:

            Councilwoman Debbie Ryan has talked to Attorney Greg Reed about putting the minutes on the Eagleville website starting with the New Year, and has worked with Michelle regarding the procedure.  The January meeting will be posted after they are adopted on February 19th. 

  

Safety Grant:

            Mayor Barham informed the council that he was notified by TDOT that Eagleville was selected to receive a Tennessee Governor’s Highway Safety Grant (Federal money, through TDOT) for any type of traffic sign and safety signs.  The grant does not include street signs or welcome signs.  A transportation research group from UT will arrive this spring, evaluate what is needed, and report to the Nashville office.  Up to $10,000.00 can be awarded.  Mayor Barham told the State office that we would accept.    

 ADJOURNMENT

            With no further business to discuss, Councilman Harold Vincion moved the meeting be adjourned, seconded by Councilman David Rigsby.  Meeting was dismissed by unanimous vote at 8:05 p.m.
