MINUTES OF THE regular session

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE

June 22, 2004  

The City Council of the Town of Eagleville , Rutherford County, Tennessee, met in regular session at 7:00 p.m. on June 22, 2004 , in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

INVOCATION

Councilman David Rigsby delivered the Invocation.   

PLEDGE OF ALLEGIANCE

Ms. Emily Porter led the Pledge of Allegiance to the flag.  

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

CITIZEN’S INPUT

            None.  

RECOGNITION

Eagleville School Teacher Retirements

            Mayor Barham recognized and congratulated retiring Eagleville School teachers James Ray and Sara Ann Gannon.  They were presented with a Resolution from the Town of Eagleville .  Mr. Gannon told the Council that Eagleville had been a big part of their lives for 30 years now, and that they have seen a lot of changes in the town, especially in the school, and met a lot of nice people.  Both teachers thanked the town and Council for the recognition and honor.   

Youth Leadership Rutherford

            Mayor Barham presented Ms. Emily Porter with a plaque from the town for representing Eagleville School in Youth Leadership Rutherford.  The Mayor explained the role of the organization and how the students were involved.  Ms. Porter thanked the Council.  

APPROVAL OF MINUTES

            The minutes were approved as presented.  A roll call vote was administered by Sherry Marsalis and answered with a unanimous “Yes” from the Council, 6-0.   

ADDITIONS / DELETIONS TO AGENDA

            None.  

OLD BUSINESS

Third and Final Reading , 2004/2005 City Budget

            The Council was given an amended copy of the 2004/2005 Town Budget.  All bills had been paid through June 30, 2004 .  Councilman David Rigsby made the motion to accept the 2004/2005 City Budget, and Vice-Mayor Ronnie Hill seconded.  Councilman Smitty asked questions regarding office supplies, dues, Economic Planning, police clothing, fuel for police cars and the Library Grant.  These questions were discussed by the Council.  A roll call vote on the 2004-2005 Budget was administered by Sherry Marsalis and answered with a unanimous “Yes” from the Council, 6-0.  

Third and Final Reading , Tax Appropriation

            Mayor Barham asked for a motion for the Third and Final Reading of the Tax Appropriation.  Vice-Mayor Ronnie Hill made the motion and Councilman Terry Zumbro seconded.  A roll call vote was administered by Sherry Marsalis and answered with a unanimous “Yes” from the Council, 6-0.  

Third and Final Reading , Tax Levy $.72 cents per $100.00

            Mayor Barham asked for a motion for the Third and Final Reading of the tax levy of .72¢ per $100.00.  Councilman Terry Zumbro made the motion and it was seconded by Councilman Harold Vincion.  A roll call vote was administered by Sherry Marsalis and the motion passed unanimously.  

Alan Farley Grant Report Update

FEMA Grant for Fire Department

Mr. Farley told the Council the U.S. Fire Administration has started awarding the Assistance to Firefighter grants.  The first 3 rounds have been awarded to date.  They will award about 25 rounds of grants between now and the end of November.  The Fire Department has a good probability of being awarded this grant.  The amount of the grant is $60,400; our 90/10 match is $6,040.   

AED Grant

Mr. Farley stated that he has spoken to the state regarding the AED grant.  They have just released the funds and are in the process making awards.  Mr. Farley was told that the Town would receive one defibulator unit that will be provided for the Police and Fire Departments to use jointly.  

TDEC Park Grant

Mr. Farley stated that the grant is still in the review process.  The grant will probably be awarded in the mid to late fall of 2004.  

Travel to Washington

            Mr. Farley also told the Council that he and Mayor Barham were preparing to depart for Washington , DC , to ask for additional funding for the planned park project.  He stated that there had been a lot of work done to date to acquire additional funding.  He stated further that he believes at least one more trip to the capital would be necessary to give the Town the best opportunity to obtain a grant.   

Mr. Farley recommended that the Council approve potential travel expenses for additional meetings on this project, because there will be a lot of work required after the initial meeting to obtain additional monies.  He believes the extra work will be worth the effort if the Town is successful in obtaining additional funding.  Councilman Harold Vincion made a motion to approve all future expenditures as needed and Councilman David Rigsby seconded the motion.  A roll call vote was administered by Sherry Marsalis and the motion passed unanimously.   

NEW BUSINESS

2003/2004 Budget Reconciliation

            Mayor Barham asked for a motion to accept the 2003/2004 Budget Reconciliation.  Councilman Terry Zumbro made the motion and Councilman David Rigsby seconded the motion.  A roll call vote was administered by Sherry Marsalis and the motion passed unanimously.   

Library Appointments 2004-2007

The Mayor recommended that Nina Merritt, Mary Alice Lamb and Patti Smotherman be appointed for their three-year term, 2004-2007.  Councilwoman Debbie Ryan made a motion to approve the recommendation and Vice-Mayor Ronnie Hill seconded.  A roll call vote was administered by Sherry Marsalis and the motion passed unanimously.   

Alan Farley Contract

            Mayor Barham stated that the Council had voted for a continuance of Alan Farley’s contract in the Budget.  Mayor Barham asked for a motion to approve the contract extension for Alan’s contract for one year from September 1, 2004 .  Councilman David Rigsby made such a motion and Councilman Harold Vincion seconded.  A roll call vote was administered by Sherry Marsalis and the motion to extend Mr. Farley’s contract for an additional year from September 1, 2004 was approved.   

Recommendation from ad hoc committee for the park

            Vice-Mayor Ronnie Hill stated that the ad hoc committee met Thursday, June 17, 2004 .  He asked the Council to approve up to $5,000 to start excavation of the land so that it could start draining and grass could be planted.  Councilman Harold Vincion moved to approve the requested expenditures and Councilman David Rigsby seconded the motion.  A roll call vote was administered by Sherry Marsalis and the motion passed by a vote of 5-1; Councilman M. A. Smitty voting no.   

Highway 99

            Councilman Smitty told the Council that Commissioner Throneberry’s wife notified him that she received a letter from John Hood that the work to Highway 99 has been delayed.  Mayor Barham stated that he received a phone call and a letter that Highway 99 and Highway 96 had been delayed one more year.  Mayor Barham said that he did not know if that was final.   

POLICE BOARD REPORT

            Chief Stone thanked everyone for the cards and flowers sent because of the death of his mother and his recent illness.  He told the Council that he and his family appreciated all the support during the death of his mother and his surgery.  He stated that before he left town he called Rutherford County and asked that they have more officer’s patrol in Eagleville.  Mayor Barham called Sheriff Truman Jones and also asked for more officers around Eagleville.  Chief Stone stated that Rutherford County Sheriff’s Deputies have been checking in with all the businesses and City Hall everyday; sometimes, twice a day.  He is going to draft a letter of thanks to the Sheriff’s office. 

            There have been a couple of complaints regarding mosquitoes in swimming pools with standing rain water on the covers.  This issue has been addressed, and Ed Wettig will spray the pools for mosquitoes.   

FIRE BOARD REPORT

            The Council was given a copy of the Mutual Aid Agreement.  The Mutual Aid Agreement is a complete overhaul and vast improvement in the mutual aid and other emergency assistance in Tennessee .  Under previous laws governing mutual aid, a written agreement must have been signed and in effect prior to the occurrence of the emergency.  This act puts a basic mutual aid agreement in place effective July 1, 2004 .  It deals with TEMA and other Emergency Agencies.   

BEAUTIFICATION COMMITTEE

501(c)(3) Organization

            Councilwoman Debbie Ryan asked about the 501(c)(3) organization.  Vice-Mayor Ronnie Hill asked Attorney Reed if the Recreation Committee needed to set up a 501(c)(3) tax.  Attorney Reed stated that it is an Internal Revenue Code that gives an organization charity status and tax exempt status.  Mr. Reed opined that a 501(c)(3) organization should be a private, not governmental, enterprise.      

Election

            Vice-Mayor Ronnie Hill asked Linda Vincion that if Eagleville had their election to coincide with Rutherford County , could Eagleville avoid an election charge.  Mrs. Vincion stated that if they had their elections at the same time, there would not be a charge.   

Minutes

            Councilwoman Debbie Ryan suggested that all the minutes of the Council be maintained on the internet.  Everyone agreed.   

Water Lines

            Chief Joe Jackson told the Council that Consolidated Utility was putting in 12-inch water lines down Hwy 99.  This will come through Eagleville, and more fire hydrants will be installed.   

Street Aid

            Councilman Smitty asked why there was a $4,000 check written out to Street Aid on the May Financial Statement.  Sherry Marsalis, City Recorder, explained that the State issues a check made out payable to the Town.  She then deposits the check into the general fund account, and then writes a check to the street aid account. 

Councilman Smitty told the Council he received a call regarding Industrial Street .  He stated that the street is in poor condition.  Mayor Barham and Vice-Mayor Ronnie Hill stated that the Town wants to repair the road during construction of the park.     

ADJOURNMENT

With no further business to discuss, Councilman Harold Vincion made the motion to adjourn and Councilman David Rigsby seconded the motion.  The meeting was adjourned at 8:33 p.m.
