MINUTES OF THE REGULAR SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

March 23, 2006

 

The City Council of the Town of Eagleville, Rutherford County, Tennessee, met in regular session at 7:00 p.m. on  March 23, 2006, in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham. 

ROLL CALL

            A roll call was taken by City Recorder Michelle Bennett.  All members were present, except Councilman M. A. Smitty who arrived at 7:11 p.m.

INVOCATION

Councilman David Rigsby delivered the Invocation.     

PLEDGE OF ALLEGIANCE

Taylor Bennett led the Pledge of Allegiance to the flag.

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

RECESS CITY COUNCIL MEETING

Mayor Barham recessed the City Council meeting.

CALL TO ORDER PUBLIC HEARING – Zoning Ordinance

Mayor Barham called to order the Public Hearing on the Zoning Ordinance.  Mr. Chris Hendrix asked that his property at 1126 N. Main Street be zoned commercial.  Mayor Barham acknowledged his request and told him the City Council members would discuss it. 

ADJOURN PUBLIC HEARING

Mayor Barham adjourned the Public Hearing.

CALL BACK TO ORDER CITY COUNCIL MEETING

Mayor Barham called the City Council meeting back to order. 

RECOGNIZE EHS YOUTH LEADERSHIP RUTHERFORD STUDENTS

Mayor Barham and the City Council recognized four Youth Leadership Rutherford Students this year.  Mayor Barham presented Miss Kinsey Doss and Miss Mary Alice Porter with plaques.  Miss Jessica Webb and Miss Molly Burrows were not present at the meeting, but will be given their plaques on Friday, March 24, 2006 at Eagleville School.   

CITIZEN’S INPUT

            The Mayor invited input from citizens present, but there was none.  

APPROVAL OF MINUTES

            Councilman Harold Vincion moved to approve the February minutes, with Councilman Terry Zumbro seconding.  A roll call vote was administered by Michelle Bennett and the motion passed 5-0.  (Councilman Smitty was not present) 

ADDITIONS / DELETIONS TO AGENDA

            None.   

OLD BUSINESS

Grant Facilitator Report

Ø        Mr. Alan Farley reported that he is pushing a bill to get a tax exempt status on fuel for the Fire Department.  

Ø        He has also submitted a grant from a private foundation that targets rural athletic facilities.  It’s a 100% funded grant, which could be up to $100,000.  It has passed the first phase of three required.    

Ø        Chief Stone asked Mr. Farley if there were any grants/funds anywhere for police departments.  Mr. Farley stated that he did not have any requests in right now for the Police Department.  He stated that he is waiting on the Department of Justice to go ahead and fund the Cops Fast Grant again.  Mayor Barham stated that was one of the main emphasis on his Washington D.C. trip last week.  He received the information on the contacts that he is supposed to make and will start on that project very soon. 

Park Update

Ø      Vice-Mayor Ronnie Hill updated the Council that Jeff Mooneyham and Tony Underwood ran wiring for the scoreboards and the waterlines into the concession stand building.   

Ø      Middle Tennessee Electric have installed four poles with lights.  There are still four to be installed. 

Ø      Chief Stone stated that the equipment is in for the underground trenching.  He hopes to install the pipe in conduit this weekend.  Then he can get the transformer set and install the main breakers.  Most all the electrical should be installed in the next week depending on the weather.  

Ø      Vice-Mayor Ronnie Hill stated that they are going to pick up the bleachers in Kentucky on Monday. 

Ø      Vice-Mayor Hill stated that they had applied to the Rutherford County Conservation Board for a 2/3 match grant.  The request would pay for the plumbing fixtures for the restrooms.  It was requested using the name of the City of Eagleville Park.  The Board does not give money to municipalities.  If the County Attorney denies this request, we will send in another request in the name of Eagleville Ball Club.  Eagleville would have to provide a bank statement showing $2,000 in the account.  Vice-Mayor asked Attorney Reed if there was a way to give Eagleville Ball Club $2,000 for this.  They in turn would give the equipment back to the park (donation from the ball club to the City).  Greg Reed stated that the Charter restricts the Town from making such donations.  Councilman Smitty asked if we could buy something from the ball club for $2,000, and Mr. Farley stated that a private individual could make a $2,000 gift.  Mr. Hill told the Council that Farm Sales & Service had planned on making a donation to the park, and he may make it to the Eagleville Ball Club. 

Opening of Bids for Playground 

             The only bid received for playground equipment was opened by Vice-Mayor Hill.  It was from Kidz Zone Play Systems in the amount of $52,000.  After discussion, Councilman David Rigsby made the motion to accept the bid and Councilwoman Debbie Ryan seconded.  A roll call vote was administered by Michelle Bennett and the motion passed 6-0.            

 Zoning Ordinance - Second Reading

             Mayor Barham presented the Zoning Ordinance to the City Council for the second reading.  The Planning Commission made the motion to approve the Zoning Ordinance with the inclusion of the property at 138 Allisona Road zoned as commercial (C2).  Councilman Terry Zumbro seconded.  Mayor Barham stated that Mr. Chris Hendrix had also requested his property at 1126 N. Main Street to also be zoned commercial.  Councilman Harold Vincion stated that Mr. Hendrix’s request must come before the Planning Commission for approval first.  Mayor Barham asked Mr. Hendrix if he could be at the April 3rd meeting, and Mr. Hendrix stated he could.  After review and discussion of the Zoning Ordinance and Map, a roll call vote was administered by Michelle Bennett and the motion passed unanimously.  

NEW BUSINESS

Hazard Mitigation Plan Resolution #R-06-02

            Attorney Greg Reed presented the City Council Members with a resolution adopting the Rutherford County Hazard Mitigation Plan.  Councilman Harold Vincion made the motion to accept Resolution #R-06-02 with Councilman Terry Zumbro seconding.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously.

COUNCIL BOARD, SPECIAL REPORTS

Police Board Report

            Chief Stone stated that there had been a couple of complaints regarding rowdy kids leaving school in the afternoon.  He stated that these had been investigated and he  was going to be spending more time at the school during the school zone times.               

Fire Board Report

            Michelle Bennett reported that the Country Ham breakfast went very well.  The Fire Department profited around $1,000, and made a $150 on the two Country Hams that were raffled.  She also stated that the department wants to have a breakfast fund raiser every quarter. 

Beautification Committee

             Councilwoman Debbie Ryan told the Council that they are getting ready for the

Easter Egg Hunt at the Community Center again this year.   

OTHER BUSINESS

            Councilman Smitty noticed on the deposit detail on the February Financial Statement that CUD had paid the city $1,810 for a building permit for the new pump station on Hwy 41-A.  He stated that he appreciated CUD being here and providing services for Eagleville and wanted to know if the town could refund all or a portion of the building permit fee back to them.  He stated that since they are a not for profit organization and providing us a very important service, he felt they should not have been charged. 

            Attorney Greg Reed responded by saying that if the town wanted to waive the building permit fee that it should have been discussed before the payment was made.  Now that they have paid, if we refunded the money it would be deemed a gift.  Under the Town Charter, that is not allowed, in his opinion.   

MAYOR’S CLOSING REMARKS

Ø      Mayor Barham asked everyone to remember Larry Hazelwood’s family during this time. 

Ø      He also asked everyone to remember Councilman Smitty’s fish fry Friday night at the Community Center. 

ADJOURNMENT

With no further business to discuss, Councilman Smitty made the motion to adjourn and Councilman Vincion seconded.  By unanimous vote, the meeting was adjourned at 7:38 p.m.
