MINUTES OF THE REGULAR SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

September 8, 2005  

The City Council of the Town of Eagleville , Rutherford County, Tennessee, met in a called session at 7:00 p.m. on September 8, 2005 , in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham.   

ROLL CALL

            A roll call was administered by City Recorder Michelle Bennett.  All members were present except Councilwoman Debbie Ryan .   

INVOCATION

Mayor Barham asked for a moment of silence.      

PLEDGE OF ALLEGIANCE

Vice-Mayor Ronnie Hill led the Pledge of Allegiance to the flag.  

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

CITIZEN’S INPUT

            None.  

BUSINESS ITEMS

2005 Tax Ordinance – Second Reading      

Mayor Barham asked for a motion to accept the 2005 Tax Ordinance on the Second Reading.  Councilman Terry Zumbro moved and Councilman Harold Vincion seconded the motion.  A roll call vote was administered by Michelle Bennett and the motion passed 4-1, with Councilman Smitty voting no.

Drug Free Resolution #R-05-04      

Mayor Barham explained that this was an updated Drug Free Resolution for the Town of Eagleville .  After review of the resolution, Councilman M. A. Smitty made the motion to accept the Drug Free Resolution #R-05-04.  Councilman David Rigsby seconded the motion.  A roll call vote was administered by Michelle Bennett and answered with a unanimous “Yes” from the Council.   

Resolution #R-05-05, A Resolution providing for the maintenance, preservation, and protection of public records, and establishing procedures for accessing and copying public records. 

Mayor Barham told the Council that Michelle had attended a MTAS Seminar last week on Public Records.  It was stated that every town and city should have a resolution for handling of public records.  Mayor Barham asked the Council for a motion to adopt the proposed resolution.  After reviewing the resolution, Councilman David Rigsby moved and Councilman Terry Zumbro seconded the motion to adopt the proposed resolution.  During discussion Vice-Mayor Ronnie Hill asked for an amendment to Resolution #R-05-05.  He stated that he would like Section 2., A. to read as follows:  

Section 2.        Records deposition authorization:

            A.     The following positions, along with the City Recorder, are charged

                     with authorizing and approving the disposition and destruction of

                     vital records that no longer have administrative, fiscal, legal, or

                     historical value.

a.          Fire Chief

b.          Mayor

c.          Police Chief  

Councilman M. A. Smitty made the motion to adopt the amendment to the motion for Resolution #R-05-05.  Councilman David Rigsby seconded the motion.  A roll call vote was administered by Michelle Bennett and the motion to amend passed unanimously.  Mayor Barham then asked the City Recorder for a roll call vote accepting Resolution #R-05-05 as amended.  The motion, as amended, passed on a vote of 5-0.  

ADJOURNMENT

With no further business to discuss, Councilman M. A. Smitty made the motion to adjourn and Councilman David Rigsby seconded.  By unanimous vote, the meeting was adjourned at 7:13 p.m.
