MINUTES OF THE REGULAR SESSION

OF THE COUNCIL OF THE TOWN OF EAGLEVILLE , TENNESSEE  

September 29, 2005  

The City Council of the Town of Eagleville , Rutherford County, Tennessee, met in regular session at 7:00 p.m. on September 29, 2005 , in Eagleville City Hall with Mayor Nolan S. Barham, Sr., presiding.

CALL TO ORDER

The meeting was Called to Order by Mayor Nolan Barham.   

ROLL CALL

            A roll call was administered by City Recorder Michelle Bennett.  All members were present.   

INVOCATION

Councilman Harold Vincion delivered the Invocation.     

PLEDGE OF ALLEGIANCE

Alan Farley led the Pledge of Allegiance to the flag.  

MAYOR'S WELCOME

Mayor Barham welcomed everyone to the City Council meeting.  

CITIZEN’S INPUT

            None.

APPROVAL OF MINUTES

            Councilman Harold Vincion moved to approve the August 25, 2005, and the September 8, 2005 minutes.  Councilman Terry Zumbro seconded the motion.  Vice-Mayor Ronnie Hill stated the roll call needed to be changed.  He was not present at the last meeting.  A roll call vote was administered by Michelle Bennett and the motion, with roll call correction, passed 6-0.      

ADDITIONS / DELETIONS TO AGENDA

None.   

OLD BUSINESS

2005 Tax Ordinance – Third Reading

            Mayor Barham asked for a motion to approve the third and final reading of the 2005 Tax Ordinance.  Councilman David Rigsby made the motion to approve the third and final reading of the 2005 Tax Ordinance and Vice-Mayor Ronnie Hill seconded the motion.  A roll call vote was administered by Michelle Bennett and passed, 5-1, with Councilman Smitty voting no. 

Grant Facilitator Report

            A written report was passed out to all of the Council members.  Mr. Alan Farley read over the report and updated the Council on all outstanding grants. 

Grant Facilitator Contract

            Mr. Farley recommended renewing his contract for the remaining physical year (9 months) and not renew for the 2006/2007 year.  He also stated that he would cover all travel expenses.  This would allow the City to close out all existing and upcoming grant applications.  After a year or two the Council can discuss the need to renew a contract with Mr. Farley at that time. 

            Mayor Barham asked for a motion for Mr. Farley’s recommendation.  Councilman David Rigsby made the motion.  Councilman Terry Zumbro seconded.  After discussion, a roll call vote was administered by Michelle Bennett and passed, 5-1, with Councilman Smitty voting no. 

Park Update

            Vice-Mayor Ronnie Hill passed out plans of for a concession stand for the new

city park.  He explained that the Planning Commission had already approved the plans, and he would get a building permit to start building.              

NEW BUSINESS

Bids for Fencing at New City Park

            Vice-Mayor Ronnie Hill opened the two sealed bids for fencing at the new City Park .  The one from Murray Fence was $80,000.00.  The second bid, which was from Hooper Fence, was $55,350.00.  Councilman M. A. Smitty made the motion to accept the bid for $55,350.00 from Hooper Fence.  Councilman David Rigsby seconded.  A roll call vote was administered by Michelle Bennett and the motion passed unanimously.    

NIMS (NATIONAL INCIDENT MANAGEMENT SYSTEM) Resolution

            Mayor Barham stated that this had already been voted on, but there was no record of the motion and who seconded it.  Mayor Barham entertained a motion to accept the NIMS Resolution.  Councilman Harold Vincion moved and Councilwoman Debbie Ryan seconded.  A roll call vote was administered by Michelle Bennett and answered with a unanimous “Yes” from the Council, 6-0.

Resolution #R05-05

            Attorney Greg Reed stated that there was some language in this resolution that needed to be changed.  Attorney Reed stated that it should read…

Section 2.        Records deposition authorization:  

A.          It shall require two authorized Town officials to authorize and/or approve the disposition and/or destruction of vital records that no longer have administrative, fiscal, legal or historical value.   

The first Town official so charged and authorized shall be the City Recorder.  The City Recorder is the required Town official for such decisions.  

The second authorized and required Town official shall be one of the following Town officials:

a.          Fire Chief

b.          Mayor

c.          Police Chief  

2004-2005 Budget Ordinance Amendment

            Mayor Barham presented to the Council the 2004-2005 Budget Ordinance Amendment that balances out the funds for the year.  Councilman Terry Zumbro made the motion to accept the 2004-2005 Budge Ordinance Amendment, and Councilman David Rigsby seconded.  A roll call vote was taken by Michelle Bennett and passed by unanimous vote.

 Septic Bids

             Vice-Mayor Ronnie Hill opened the only bid for the pumping of the septic tank.  It was from Jones Septic for $165.00 for each pumping.  Councilman M. A. Smitty made the motion to accept the bid, and Councilwoman Debbie Ryan seconded.  A roll call vote was administered by Michelle Bennett and answered with a unanimous “Yes” from the Council, 6-0. 

POLICE BOARD REPORT

            Chief Stone stated that he and Michelle had finalized the sign grant.  The signs have been ordered and should be delivered in a couple of weeks.  Councilman Smitty told Chief Stone that he would volunteer to help put up the signs after they arrived. 

            Chief Stone asked the Council to consider purchasing spike strips for the Police Department.  Councilman Smitty made the motion to spend up to $750.00 to purchase the spike strips, and Councilman David Rigsby seconded.  A roll call vote was taken by Michelle Bennett and passed by unanimous vote.  

FIRE BOARD REPORT

            No report.   

bEAUTIFICATION cOMMITTEE

            Councilwoman Debbie Ryan stated that they are getting ready for the Fall Festival on October 22, 2005.   

MAYOR’S CLOSING REMARKS

Mayor Barham mentioned to the Council that the Police Department and the Fire Department were out patrolling the night of the recent storm.  He thanked both departments for their hard work. 

Mayor Barham also stated that in 1999, all the Mayors in Rutherford County approved a 100% signage grant with TDOT.  This was an experimental program with all balances of funds not from the grant to be paid by the Christy Houston Foundation.  It is a family of signs for tourism along with entrance signs into the cities.  There will be a committee set up from each city to meet with the Rutherford County Chamber of Commerce to discuss sign locations. 

Councilman Smitty

            Councilman Smitty stated that on the financial statement, he would like a detailed report for Platinum Plus for Business. 

Vice-Mayor Ronnie Hill

            Vice-Mayor Ronnie Hill told the Council that a citizen had inquired about the progress of naming the bridge after John Redmond.  Mayor Barham stated that all necessary letter and requests were sent to the Representative Curt Cobb and Senator Bill Ketron a few months ago.  They will sponsor the necessary legislation for the General Assembly hopefully in January.

            Councilwoman Debbie Ryan stated that she had heard a couple of nice comments about our City Recorder this past month and wanted to make everyone aware of that.   

ADJOURNMENT

With no further business to discuss, Councilwoman Debbie Ryan made the motion to adjourn and Councilman David Rigsby seconded.  By unanimous vote, the meeting was adjourned at 7:45 p.m.
