ROLL CALL
Roll was called by City Recorder, Colleen Adams. All members were present, with the exception of
Mayor Nolan S. Barham, Sr.
ANNOUNCEMENT Vice
Mayor Ronnie Hill read a letter from Mayor Nolan S. Barham, Sr. that was left with City Recorder Colleen Adams earlier in
the day. The letter stated that effective today at 5:00 pm, Nolan S. Barham, Sr. would be resigning as
Mayor of Eagleville.
ADOPTION OF AGENDA Motion was made
by Councilman Alan Ball and seconded by Councilman Wes Fitzgerald. After a vote taken by City Recorder
Colleen Adams, the motion passed 5-0.

NEW BUSINESS
Accept Resignation of Councilman Harold Vincion Councilman
Wes Fitzgerald made a motion to accept the resignation of Councilman Harold Vincion, and seconded by Councilman
Alan Ball. City Attorney Adams Dodd spoke, and stated that there was some question as to the validity
of the resignation since no written statement was presented to the Council. Mr. Dodd stated that the verbal
resignation was valid. City Recorder Colleen Adams stated at the Vice Mayors request she had contacted
Mr. Vincion who stated he would not be submitting a written resignation. After a vote taken by City Recorder
Colleen Adams, the motion passed 4-1, with Councilman David Rigsby voting “no”.
Filling
of Council Vacancy
Councilman Wes Fitzgerald made a motion to appoint Donna Jensen to fill the vacancy on the City Council.
Motion was seconded by Councilman Alan Ball. After a vote taken by City Recorder Colleen Adams,
the motion passed 5-0. City Recorder Colleen Adams then swore Ms. Jensen in as a Council member, and Councilwoman
Jensen took her seat at the Council table.
OLD BUSINESS
COPS Grant
Councilman Alan Ball asked about the status of the COPS Grant. City Recorder Colleen Adams
stated she had about ¾ of the application completed, and had a few questions she was still in the process of answering,
and requested that someone review the letter of intent who has worked on a Police force who could give insight.
Councilman Wes Fitzgerald stated he had a few contacts he could put in contact with Ms. Adams. Ms.
Adams stated that there should be no problem meeting the deadline.
Building
Maintenance
Councilman Wes Fitzgerald complimented City Recorder Colleen Adams on the interior redecorating she did of
the lobby, and stated he would like to discuss plans for fixing up City Hall’s exterior. City Recorder
Colleen Adams stated there was approximately $1,600 left in the building maintenance fund for the budget year, and suggested
the City hire an “on-call” maintenance person, due to the fact there was this and many other odd jobs needing
to be done in and around City Hall. After discussion, it was decided that bids were not needed, and it
was decided the City would purchase the paint, and then hire someone to paint. Attorney Adam Dodd suggested
the Council consider inviting bids, due to the economy and people needing work. Vice Mayor Ronnie Hill
agreed, and stated that the repair of the windows, gutters, and other items be addressed prior to painting, and that a list
be made of all items needing to be repaired. Councilman Wes Fitzgerald questioned the need for a dumpster
at City Hall, and stated it looked horrible outside City Hall, and suggested that City Recorder Colleen Adams take the trash
off to save the $35 month in pick up fees. After discussion, it was decide the City Recorder should not
be hauling trash. City Recorder Colleen Adams stated the City was under contract with Waste Management
until September, and has a lower cost company that the City could change to at that time. Councilman Fitzgerald
stated he would like to see some of the tires, street signs, poles and other items around outside City Hall be cleaned up.
Councilman Fitzgerald also stated that he has a friend who is a personal designer, and he hired her on his dime to
put together a design format and color scheme for the exterior of City Hall. Councilwoman Jensen suggested
that the Council put together a committee to list the repairs needed, pick colors, and anything needed. Councilman
Fitzgerald made a motion that Councilwoman Jensen Head the Building Maintenance Committee and was seconded by Councilman Alan
Ball. Vice Mayor Ronnie Hill made a motion to amend the motion and add Councilman Sam Tune to the committee,
and was seconded by Councilman Fitzgerald. After a vote taken by City Recorder Colleen Adams, the motion
to develop a Building Maintenance Committee headed by Councilwoman Donna Jensen and Councilman Sam Tune passed 5-0.
Follow Up Discussion with City Attorney Regarding Beer Sales City Attorney
Adam Dodd presented to the Council documents pertaining to which included a sample Ordinance that the council will need to
review and possibly make changes to regarding and outlining provisions for the sales of Beer. Mr. Dodd
stated he had looked into it, and a Beer Board would need to be developed, with most small Towns appointing their City Council
as the Beer Board. Mr. Dodd informed the Council of and explained the mandatory State fees for Beer permits,
applications, and the privilege tax. Discussion took place regarding the roles and discretions and
responsibilities of the City Recorder and Beer Board in accepting, approving and issuing applications. Mr.
Dodd stated the Sales of Beer would need to be passed by ordinance, and that the ordinance be precisely worded to control
the sales and restrict the percentage of consumptions, percentage of sales, and other permit regulations, open container sales
versus by the container, etc. Mr. Dodd stated the State of Tennessee set the tax rate, and the City
would need to set up a mechanism to turn the taxes in to the State. Mr. Dodd stated the provisions in the
proposed Beer regulations would need to be specific in regulations, rules, zoning restrictions and what the Beer Board could
do about complaints in addition to setting a acceptable footage that businesses selling Beer would need to be away from Churches,
schools, etc. Councilman David Rigsby spoke and stated he was not in favor of the Beer sales and that he
feels that the residents should vote on this issue. Mr. Dodd stated that if the Council would like to make
revisions to the documents he presented, he would make the changes and present at the next City Council meeting.
Mr. Dodd reminded the Council 3 readings would need to be held before the Ordinance was passed, and recommended that
the Council hold a work session prior to the 1st reading to review and decide on provisions for the Ordinance.
Councilwoman Jensen stated she would like to see a works session held to fully discuss the issues. After
discussion, it was decided to have a called City Council meeting to hold a workshop regarding the proposed Beer Ordinance
on Tuesday, April 14, 2009 at 7:00 pm.
CLOSING REMARKS
Vice Mayor Ronnie Hill stated that per the Charter, he
would be filling in as Mayor until the next regular City Council meeting, where the Council will need to appoint a Mayor.
Vice Mayor Hill stated he would be filling in temporarily and does not want to become the Mayor. Vice Mayor Hill stated that
due to the fact the all City checks require 2 signatures, and in the interim before a new Mayor would be appointed, City Recorder
Colleen Adams would be signing her own checks in addition to his signature. Vice Mayor
Hill stated that there is a policy in place preventing the signing of own checks, but it would need to be
done in this case and wanted everyone to be aware.
Councilman Wes Fitzgerald asked City Attorney Adam Dodd if there were any items “on the table” left by
former Mayor Barham that needed to be addressed. Mr. Dodd stated that since the items were not on the agenda,
he had nothing to report, but would discuss anything that needed to be discussed at the next regular City Council meeting.
Councilman Fitzgerald asked about procedures for employees leaving the city, and it was stated by City Recorder that
Mr. Barham turned in his keys this morning, and signed a contract which was turned in to Verizon stating he would be financially
responsible for his cell phone.
Councilman Alan Ball thanked everyone for coming to the meeting, and welcomed Councilwoman Donna Jensen.

Councilman Wes Fitzgerald made a motion for adjournment, with Councilman Alan Ball seconding.
The meeting ended at 7:05 pm with a unanimous “aye”.

MAYOR'S
WELCOME
Vice Mayor Ronnie Hill
welcomed everyone to the City Council meeting and stated he was glad to see such a large number of people, because it showed
they cared about the City.
ADOPTION OF AGENDA
Councilman Alan Ball made a motion to approve the agenda as amended, and was seconded by Councilman Wes Fitzgerald.
Councilman Tune asked that an item be added to address the sewer update. Councilman Fitzgerald asked that two items
be added; an update to the crosswalk pole, and, to discuss building maintenance. After a vote taken by City Recorder
Colleen Adams, the motion passed 6-0.
CITIZEN'S INPUT
Mr. Buddy Gadd spoke, and stated he operated a Pizza Shop here in town. He asked that due to the large number
of residents at the meetings, if the Council could hold the meetings at the Eagleville Community Center, and stated he feels
the need for a bridge on Clark Street.
Ms. Nina Merritt from the Eagleville Library spoke, and presented the 2009/10 Budget to the Council. Ms. Merritt stated
that circulation and computer usage is up, and wanted to remind everyone that the Library offered services such as help with
job loss, resumes, and job searches.
Mr. Andy Soapes spoke, and stated that he would like to see Citizens Input under "All Other Business" on the agenda.
Mr. Lanny Turner spoke, and stated he wanted
to make City Hall aware there is street lights out on Cheatham Springs Road. Vice Mayor Ronnie Hill stated that
if the pole number and outage was reported to City Hall, it would be called in to MTEC.
FINANCIAL
REPORT
Motion was made by
Councilman Sam Tune to approve the March 2009 Financial Report, with Councilman Alan Ball seconding. Councilman Ball
questioned the Year-to-date budget status and the $623.56 payment to DNJ. City Recorder Colleen Adams explained the
payment was for the Public Notice for the City Council meeting regarding the sewer. Councilman Wes Fitzgerald questioned
the cost of accounting fees, and it was explained they were the consulting fees from Hall & Davidson who were needed to
train the City Recorder since there was no one else her first year, and that these expenses have gone down as she becomes
more trained. Councilman Fitzgerald suggested that the City look into the cost of the accounting firm, and see if the
services could be obtained at a lower cost. Councilman Fitzgerald also asked about the payments made to Ed Wettig from
the Street Aid Account. Vice Mayor Ronnie Hill explained the City hired Mr. Wettig on an hourly basis to perform Street
work, trimming, etc. After a vote taken by City Recorder Colleen Adams, the motion passed 5-0, with Councilwoman Donna
Jensen passing on the vote.
APPROVAL
OF MINUTES
The minutes of
the March 19 and 26, 2009 City Council meetings were approved as mailed. After a motion was made by Councilman Wes Fitzgerald,
and seconded but Councilman Sam Tune, a roll call vote was administered by City Recorder Colleen Adams and answered with a
unanimous "Yes" from the Council, 6-0.
PARK REPORT
Vice Mayor Ronnie Hill reported that the Park Board met last week and it was decided that instead of having the Park-n-Show
Car Show, they would be having a Main Street Festival on June 13th that will include a Car Show, Motorcycle Show,
Live Music and Craft Booths. The food will be supplied by all local restaurants with booths going all through town.
He also stated they will have the flyers ready next week to do heavy promoting, and will need all the help they can get.
Vice Mayor Hill further stated the Park will get the proceeds from the Car and Motorcycle Shows and all restaurants will keep
the money they earn. He also stated they will contact RCSO for additional deputies for traffic control.
Councilman Sam Tune stated the purpose of this was to capitalize on all Eagleville has to offer and would like for all merchants
in town need to be involved. Councilman Ball suggested a budget and goal be set for the festival.
Councilman
Tune stated an organizational meeting will be held for the festival, and all are invited to attend.
FIRE
REPORT
Captain Terry Greene
stated that Chief Martin was unable to attend, and he will be reading from a prepared statement from the Chief. In the
statement, it was told that there were 10 fire calls responded to in the past month, a training room is being finished in
the back, and there are 10 new Fire Fighters, with one Fire Fighter, Daniel Rowell, completing Fire Fighter 1 School.
All in attendance applauded Mr. Rowell on his accomplishment. Captain Greene explained all County Firefighters are required
to get 110 hours of training per year. He further stated that they responded to the areas hit by the Murfreesboro Tornados
earlier in the month, and assisted in cleanup and distributing water. Chief Martin wanted the Council to know he was
extremely proud of his Department and all others who help aid the Tornado victims. Chief Martin further stated in his
letter that the Fire Department has a TV and DVD player in their training room - which is used for training. Much of
the materials for the room and items in it were donated. Captain Greene then made a statement of his own, and spoke
to the council in stating that he is frustrated in the lack of support for the Fire Department and community. He stated
he feels that there has been a lack of communication and would like the Council to know that they work hard and are dedicated,
and if something is questioned to please address the Department, because he has heard members of the community comment on
things that were not accurate. Councilman Tune stated he acknowledges the Fire Personnel work hard on training, and
is proud of them. Councilman Rigsby stated that the Department is better than it has been in years.
POLICE REPORT
City Recorder Colleen Adams stated she had turned the COPS Grant application in and made the deadline. She further stated
the application was for the funding of 2 full time Police Officers salary and benefits for 3 years, with a total of $248,000.00
being requested. Ms. Adams further stated that a decision would be made sometime near the end of the summer on if Eagleville's
application was approved and if the grant funds would be paid.
CODES REPORT
Codes Administrator Linda Lichtenberger stated that she had given a report to the Council for review, and she is proceeding
on enforcing codes for a property on Main Street that had been in controversy. She further stated that she had attended
a Community Code & Building Administration meeting in Memphis, and received the President's Award for her hard work
and Dedication. She was applauded by all in attendance. Ms. Lichtenberger also spoke of a Grant Act Bill regarding
Codes and Zoning now in discussion in Washington.
OLD BUSINESS
First Reading
- Resolution 09-01
A motion
was made by Councilman Wes Fitzgerald and seconded by Councilman Alan Ball. Councilman Wes Fitzgerald stated that perhaps
they should look at some of the wording in the Resolution. After a vote taken by City Recorder Colleen Adams, the motion passed
with approval of 5-1, with Councilman David Rigsby voting "No".
Crosswalk Pole
Councilman Wes Fitzgerald stated he had checked, and it was no approval was needed to move the pole from its present
location. He further stated he would like to file the claim with Insurance and asked City Recorder Colleen Adams to
look into calling the Sheriffs Department about a report, to take pictures, and follow up on claim.
Building
Maintenance Committee
Councilwoman
Jensen stated she and Councilman Tune have looked at the building and found items needed for repair before the building could
be painted. Councilman Tune stated he would like to propose that the City hire someone to fix and repair the building,
and then on a Saturday get volunteers to come down and paint. Councilman Fitzgerald stated he had someone who
is a professional designer to put together a color scheme for City Hall and presented to the council 2 sample color schemes
for the building. He further stated that the color scheme could be used and incorporated into other businesses
and buildings in town. Councilwoman Jensen made a motion to replace herself from Head of the Building Maintenance
Committee with Councilman Wes Fitzgerald. After a vote taken by City Recorder Colleen Adams, the motion passed 6-0.
Councilman Alan Ball made a motion for the Building Maintenance Committee to choose the colors for City Hall and was seconded
by Councilwoman Donna Jensen. The motion passed 6-0, after a vote taken by City Recorder Colleen Adams.
Sewer Report
Councilman Sam Tune reported that the work was still progressing on the Sewer Feasibility, and he has attended several meetings
and been on the phone trying to learn about sewers. He stated that next Monday at 9:00 am in City Hall, an informative
meeting will be held by consultants.
NEW BUSINESS
Councilman David Rigsby addressed the Council, and stated he had been thinking about a lot of problems. He
stated that he was against beer, and knows his church, and other area churches are against it. Councilman Rigsby stated
he had many family members and friends affected by drinking and gave some examples of how alcohol was the cause of their deaths,
injuries or damaged relationships. Councilman Rigsby stated he is against the Beer and will vote against it, and stated
there are other ways the City can increase revenue, and suggested that Councilman Tune move his new development into the City
limits for the Tax revenue and extend the City limits for more Tax revenue. Councilman Rigsby further stated that
the Council needs to do whatever they can to help developers but insist that they be in the City limits and stated that not
enough beer would be drank to affect the revenue but that property and houses would increase it. He stated that for
the past 2-3 years he has heard how bad the septic system Lanny Turner put in his development, but at least his development
was in the City limits and now it is said that his system was most likely what the City will need to use. He then
stated that he would no longer ask the City Recorder to come back to City Hall on her spare time so he could review the checks.
He further stated she is already being paid to take care of the checks and it was not fair to ask her to come on her off time.
Councilman Rigsby then stated that the items against Nolan Barham were ridiculous and it was finished and does not want to
hear about it anymore. He stated that the new Council will be good for Eagleville and it is time for the Council to
move on and bring new businesses and property into town. Councilman Tune stated to Councilman Rigsby that they will
not always agree but he listened to him and respected his opinions, and that Annexation may need to be looked at. Councilman
Rigsby stated it would be a great thing for the Council Members to step up and move their homes or developments inside the
City Limits. Vice Mayor Ronnie Hill thanked Councilman David Rigsby for his comments and stated he respected his opinions.
NEW BUSINESS
First Reading - Ordinance 09-02
Vice Mayor Ronnie Hill asked the Council to look at the budget they received in their packet. Vice Mayor Ronnie Hill
stated the letter they received along with the budget did not include a paragraph regarding pay increases for City Employees.
The Council members went through the budget, line item by line item and after discussion made kept items the same or made
changes to the budget as discussed and agreed upon. New line items were added for Public Notices and Unemployment. After
discussing for an hour, a motion was made by Councilman David Rigsby to approve the 1st Reading of Ordinance 09-02
(2009/2010 Budget) and seconded by Councilman Sam Tune. After a vote taken by City Recorder Colleen Adams, the motion
passed 6-0.
OTHER BUSINESS
Appointment of New Mayor
A motion was made by Vice Mayor Ronnie Hill, and seconded by Councilman Wes Fitzgerald, to appoint Councilman Sam
Tune as Mayor. After a vote taken by City Recorder Colleen Adams, the motion passed 5-0. Mayor Tune was immediately
sworn in by City Recorder Colleen Adams. All in attendance applauded. Mayor Tune then addressed the Council and
others in attendance and thanked them for their support. Mayor Tune stated that he will take this position seriously
and will do what needs to be done on behalf of the City. Mayor Tune further stated there was a lot of work to do and
a lot on the table and help will be needed from the Council, the residents and the business district and would like to see
a better relationship and better communication between the City Council and Planning Commission. Mayor Tune challenged
everyone in attendance to bring somebody with them to the next Council meeting and encourages every citizen to be involved
in the City.
Glenda Dyer Proposal
Ms. Glenda Dyer presented and read to the Council a proposal for her to become the Records Management Coordinator for the
City. According to the proposal, Ms. Dyer will have access to all City records and documents, to inventory, file, review
and store records or other duties as needed to begin on May 11th 2009, and will work under the supervision of and
report to the City Council. Ms. Dyer's proposal is for one year, and will be for the sum of $1.00. Councilman
Alan Ball made a motion, and was seconded by Councilwoman Donna Jensen, to accept the Proposal for Glenda Dyer to become the
Records Management Coordinator. After discussion, a vote was taken by City Recorder Colleen Adams and the motion passed
5-0.
ADJOURNMENT
Mayor Sam Tune stated much had been accomplished tonight, and again challenged all residents to bring someone with them to
the next City Council meeting.

Tune declared a motion was in order, and a motion was made by Councilman Wes Fitzgerald for adjournment and seconded by Councilman
Alan Ball. After a vote taken by City Recorder Colleen Adams, the motion passed 5-0, and the meeting ended at 10:25
pm.
