Mayor and City Council members met in a called session in the Eagleville City Hall, City of Eagleville, Rutherford County,
Tennessee on July 2, 2009 at 7:00 pm with Mayor Sam Tune presiding.

Roll was
called by City Recorder, Colleen Adams. All members were present, with the exception of Councilman Alan Ball.
CALL TO ORDER
Mayor
Tune called the meeting to order and welcomed everyone to the meeting.
ADOPTION OF THE AGENDA
Councilman Wes Fitzgerald made a motion to adopt the agenda, with Councilman Darin Rowell seconding. After a roll call
was taken by City Recorder Colleen Adams, the motion was approved 5-0.
BUSINESS
CITY
ATTORNEY
Mayor Tune stated
to the Council that City Attorney Adam Dodd had resigned effective immediately. A motion was made by Councilman Wes
Fitzgerald to accept the resignation, and was seconded by Councilman Darin Rowell. After a vote taken by City Recorder
Colleen Adams, the motion passed 5-0.
Mayor
Tune addressed the Council, and stated he had a recommendation for a new City Attorney, Mr. Leon Sharber. Mayor Tune
stated that Mr. Sharber has agreed to attend every meeting, and if he is not able to make it has agreed to have representation
here or will let the City know when he will not make it. He also stated that Mr. Sharber has agreed to do all City business,
such as write letters and make phone calls, and may charge extra for additional work. He explained Mr. Sharber has been
practicing law for 30+ years and gave a description of his qualifications. Councilwoman Jensen asked to see Mr.
Sharber's resume, and for a detailed list of expectations of the City. After discussion, a motion was made
by Councilman Wes Fitzgerald, and seconded by Darin Rowell to hire Mr. Sharber at $550.00 per month, with a 12 month contract,
a 90 day probationary period and with the understanding Mr. Sharber is to provide to the Mayor and City Council with a contract
stating the expectations and fees. After a vote taken by City Recorder Colleen Adams, the motion passed 5-1 (Councilman
Ball passed, stating he arrived late and missed discussions).
ADJOURNMENT
Mayor Tune stated a motion was in order to adjourn, and the meeting ended at 6:25 pm by unanimous vote.

Roll was
called by City Recorder, Colleen Adams. All members were present.
CALL TO ORDER
Mayor Tune called to order the meeting at 7:02 pm and welcomed everyone to the meeting and thanked all for being
here. Mayor Tune stated to all in attendance that Citizens Input time is on the agenda, and to please comment or ask
questions during that time, and not speak out during the meeting. Mayor Tune then introduced new City Attorney Leon
Sharber. Mayor Tune then stated that prior to the meeting he was given a new gavel that was handmade by Mr. Thomas Hall.
Mr. Hall spoke and told the story of how the tree which the gavel was made from came to be, and how he made it. Mayor
Tune thanked Mr. Hall again, and commented on the specialness of the gift.
ADOPTION OF THE AGENDA
Councilman David Rigsby made a motion to adopt the agenda, with Councilman Alan Ball seconding. After discussion, an
item regarding a Gun Ban for the City Park was added. After a roll call was taken by City Recorder Colleen Adams, the motion
as amended was approved 6-0.
CITIZENS INPUT
David Turner spoke and stated he has safety concerns regarding Clark Street and the bridge on it, and the variance for the
ingress/egress granted on it.
FINANCIAL REPORT
Councilman Wes Fitzgerald made a motion to accept the June 2009 Financial Reports as mailed and was seconded by Councilman
Alan Ball. After a short discussion, vote was taken by City Recorder Colleen Adams, and the motion passed 6-0.
MINUTES
Councilman
Wes Fitzgerald made a motion to approve the June 25, 2009 minutes as mailed, and was seconded by Vice Mayor Ronnie Hill.
After a vote taken by City Recorder Colleen Adams, the motion passed 6-0.
PARK REPORT
Vice Mayor Ronnie Hill stated he had nothing much to report. He stated the profits from the Main Street Festival
were about $1,600.00. He then stated to the Council that the deadline for passing an Ordinance Banning Handguns from
the City Park was September 1, 2009, and the Council would need to decide if they wanted to ban guns from the park soon.
After discussion, the matter was deferred to the next meeting.
FIRE REPORT
None (Chief Martin was out of town)
POLICE REPORT
Mayor Tune reported there was no
news yet regarding the COPS Grant which the City applied for. After a discussion regarding the coverage currently being
received by the Rutherford County Sheriffs Department, and how the grant will impact it if approved, Mayor Tune stated he
would be meeting Sheriff Truman Jones.
ZONING REPORT
Mayor Tune stated that Codes Administrator Linda Lichtenberger was out of town and read from a report prepared by her.
The report stated that the Planning Commission ha recently granted an ingress/egress variance to Mr. John Lewis on Clark Street,
and that Mr. Lewis has submitted a request to combine his 2 lots. In her report, Ms. Lichtenberger stated that research
is being done to find the septic permits for the property located on Clark Street, and studies are being done.
RECORDS REPORT
Glenda Dyer presented to the Mayor and Council a
book of all ordinances passed since January 2004 to add to their municipal codes books. She reported she cannot locate
the City Council Minutes from 1971-1978. Ms. Dyer also told the Council she spoke to someone at the State Archives office,
and they will microfische the City documents if the Council will approve. Mayor Tune commended Ms. Dyer for her work
in finding documents relating to matters of concern.
SEWER REPORT
Mayor Tune reported the Sewer is in the works and he has great concern regarding the health reports regarding the
local creeks. Mayor Tune stated that the Council will need to move as fast regarding the Sewer, but no hasty decisions
should be made, and that when it is time for the Council to make a decision, they will need to begin with sending letters
to engineers to choose one, then determining what type of system will work best. Mayor Tune further stated out of the
three (3) options; Sand Filter System, deep Water/Schaeffer System, or the Membrane System, he feels the Membrane System
will work the best due to the anticipated growth of the City. Mayor Tune explained with the Membrane System, the cost
advantages will be about the same as the other systems and that the system will work in a small space. Mayor Tune suggested
to the Council that they hold a Called City Council meeting soon to discuss the sewer and further stated he has been meeting
and talking with people and it appears financial help is available. Mayor Tune stated due to the bad results
of the tests done in the local creeks, it is a health hazard. Mayor Tune presented to the Council and City Recorder
a petition to be signed by them stating they support his actions in looking for funds for a sewer. After discussion,
it was determined a called meeting would be planned and that a committee would need to be formed to help with research and
to report to the Council.
OLD BUSINESS
Apology
Letter from Michelle Bennett
City Recorder Colleen Adams read
a letter to all in attendance the City received from former City Recorder Michelle Bennett. In the letter, Ms. Bennett
apologized to the Mayor, Council and residents of Eagleville for her actions, and stated she accepts full responsibility for
her conduct. In the Criminal Court for Rutherford County and regretted the mistakes she made.
Chamber
of Commerce "After Hours"
Mayor Tune stated that
the Commerce & Merchants Association of Eagleville help with the Economic Development of Eagleville, and reminded all
that the City would be hosting the "After Hours' on August 11th at Champions Run Golf Course from 5:00-7:00
pm. Mayor Tune invited all in attendance to the event and to the organizational meeting being held on Tuesday at 6:30
pm in the old bank building.
Pedestrian Pole
Mayor
Tune stated to the Council that the Insurance payment has been received for the Pedestrian Pole repairs. A motion was
made by Councilman Wes Fitzgerald and seconded by Councilman Alan Ball to have the pole moved and replaced as per the price
quote. After a vote taken by City Recorder Colleen Adams, the motion passed 6-0.
NEW BUSINESS
Horton Highway Utility Contract
A representative from Horton Highway Utility presented to the Mayor and Council with a 50 year renewal contract.
A motion was made by Councilman Wes Fitzgerald, and seconded by Councilman Alan Ball to approve the contract. After
discussion, the motion was deferred to revisit the item later in the meeting to give City Attorney Leon Sharber time to review
contract.
Signs Purchase
City Recorder Colleen Adams explained to the Mayor and Council
that new legislation had passed, and that all roadway signs will need to be installed with or replaced with the high intensity
reflective signs. She further explained the replacements are not required until 2012, but due to the fact to replace
all existing signs in the City would be expensive to do all at once and the fact new signs are needed in some areas, she
would like to order in increments beginning with 25 stop signs. After a motion was made by Councilman Wes Fitzgerald,
and seconded by Vice Mayor Ronnie Hill to order 25 High Intensity Stop signs and hardware, a vote was taken by City Recorder
Colleen Adams and the motion passed 6-0.
Street Repairs
City Recorder Colleen Adams presented to the Mayor and Council a bid that was received for various street repairs
in the City. After discussion, it was determined that Councilwoman Donna Jensen would drive to the locations and verify
repairs were needed, and extent of road damage and then report to the City Recorder if the repairs still needed to be
done, so if necessary bid notices could need to be published.
Henry Horton Contract Revisited
City Attorney Leon Sharber stated he reviewed the contract, made a few changes that would need initialing, and it was ready
to be signed. After the Mayor and Council reviewed changes and approved, City Recorder Colleen Adams called a
vote, and the motion to approve and sign the 50 year contract with Henry Horton Utility passed 6-0.
Land
Purchase Proposal
Mayor Tune stated that Mr. John E. and Judy Turner had offered
to sell the City 5 acres of property located on Highway 99 for $19,000.00 per acre. Mayor Tune presented to the Council
a map and pictures of the property. Mayor Tune also stated Mr. Turner agreed to accept $10.00 as down payment, to split
closing costs 50/50 with City, to pay for survey, and let the city close anytime in the next year. After a lengthy discussion
regarding the price, the possible uses of the property, zoning, financing of property, and other concerns, Councilman Alan
Ball made a motion and was seconded by Councilman Darin Rowell to purchase 5 acres at $19,000.00 per acre as per the conditions
outlined in the contract (copy attached). After a vote taken by City Recorder Colleen Adams, the motion passed 6-0.
ADJOURNMENT
Mayor Tune Thanked Mr. & Mrs. Turner and commented that due to the conditions in City Hall, a bigger meeting
location would be attempted for next month. A motion was made by Councilman David Rigsby, and seconded by Councilman
Darin Rowell to adjourn. My unanimous vote, the meeting ended at 9:12 pm.
