October City Council Minutes

                   OF THE TOWN OF EAGLEVILLE, TENNESSEE
                                    
October 22, 2009   7:00 PM

The Mayor and City Council members met in a regular session in the Eagleville Community Center, City of Eagleville, Rutherford County, Tennessee on October 22, 2009 at 7:00 pm with Mayor Sam Tune presiding.

CALL TO ORDER
The meeting was called to order at 7:06 pm by Mayor Tune.

INVOCATION
Mr. John E. Turner delivered the Invocation.

PLEDGE OF ALLIGIANCE
Mr. Don Lamb led the Pledge of Allegiance.

ROLL CALL
Roll was called by City Recorder Colleen Adams. All members were present, with the exception of Councilman Wes Fitzgerald.

MAYORS WELCOME & SPECIAL PRESENTATION
Mayor Tune welcomed all to the meeting, and introduced Denise Carlton and asked her to take over the meeting for as moment.

Ms. Carlton stated she was there on behalf of Rutherford County Government, and that October 2009 was the 150th Anniversary of the Rutherford County Courthouse. She further stated that the County had used this opportunity to give out Community Service Awards. Ms. Carlton stated that they had received a nomination from Eagleville, and that the nominees were one of ten who were chosen. Ms. Carlton read from the nomination they County had received, which highlighted their involvement in the Community Center, Library, and numerous other services they have provided to the Eagleville Community. Ms. Carlton then presented to Mr. Gordon Lamb and Mrs. Mary Alice Lamb the Community Service award from County Mayor Ernest Burgess. Mayor Sam Tune then presented to Mr. and Mrs. Lamb a Proclamation from the Eagleville City Council honoring them for the outstanding Community Service they have done for the City of Eagleville.

Mrs. Mary Alice Lamb spoke, and thanked all for their awards. She further stated they had no idea they would be receiving these tonight, and were very proud. Ms. Lamb stated the Community Center was dedicated 23 years ago, and over the years she had cleaned over 2,000 pounds of Chitlins for the Chitlin dinners they had for fundraisers. Mayor Tune again thanked Mr. and Mrs. Lamb for all they have done in the community, and thanked their family members for their support.

ADOPTION OF THE AGENDA
Councilman Darin Rowell made a motion to adopt the agenda, and was seconded by Vice Mayor Ronnie Hill. After a roll call vote taken by City Recorder, Colleen Adams, the motion passed 5-0.

FINANCIAL REPORT
Councilman Alan Ball commented on the profit and loss vs. actual vs. budgeted amounts, and stated he did not think the numbers were accurate. Councilman Darin Rowell asked Councilman Ball to take ownership and see what reports could be done. Councilman Ball stated he would work with City Recorder Colleen Adams to come up with a report that will clarify numbers.

Mayor Tune state that the $38,000 CD had been renewed this past week at 3 ¼% interest.

APPROVAL OF MINUTES
Vice Mayor Ronnie Hill made a motion to accept the September 24, 2009 City Council regular meeting minutes as mailed. Councilman Darin Rowell seconded the motion, and after a roll call vote taken by City Recorder, Colleen Adams, the motion passed 5-0.


Vice Mayor Ronnie Hill made a motion to approve the minutes from the September 29, 2009 called City Council meeting. Vice Mayor Hill then stated that on page 2, paragraph two, his comments as stated were incorrect. He further explained what he had meant, and City Recorder Colleen Adams stated she would make the necessary changes. Vice Mayor Hill withdrew his motion, and Councilman Darin Rowell made a motion to approve the minutes as amended. Vice Mayor Ronnie Hill seconded the motion, and after a roll call vote by City Recorder Colleen Adams, the motion passed 5-0.

PARK REPORT
Vice Mayor Ronnie reported that City Recorder Colleen Adams was working on getting the sign for the park stating "no guns allowed" and that Glenda Dyer was reviewing the current ordinance of Park Rules.

FIRE REPORT
Fire Chief David Martin stated that Fire Calls were down for the past month and it appeared people had been listening to the no burn regulations. Chief Martin state he had seen a problem with water collecting at the end of Swamp road due to the recent roadway construction, and had called TDOT, who came that day to move dirt around to correct the problem. Chief Martin then stated that the Fire Board had met and had a great meeting. Chief Martin then stated he wanted the City Council to be aware of the water problem in Eagleville, and that the current water supplies are inadequate for Fire protection. He further stated that the Fire Department needed a tanker truck and would like to look at applying for a grant to get one. Chief Martin stated to the City Council that only 2 fire hydrants in town had adequate water pressure to fight fires. Mayor Tune stated that he had discussed this issue with Mr. McElroy at C.U.D., but did not know what the final solution would be. Chief Martin stated per the 1993 contract the City of Eagleville signed with C.U.D., that the City would be responsible for upgrading the fire lines. He further stated C.U.D. is in the process of updating their lines, but for it to get to Eagleville will be about 10-15 years, and that he hoped to be able to make a recommendation to the Council at next months meeting.

Councilman Ball stated that the Fire Board met and had a good meeting earlier in the week. He also stated that the Fire Board will meet on the 4th Tuesday of each month. Councilman Ball stated that the Fire Department is in need of new equipment, turnouts and trucks. He further stated that the Department is a City Department, manned by volunteers. Councilman Ball stated that other cities give their fire departments $50,000 to $60,000 in funds, and this Council and community needs to support the Fire Department as they serve such a large area.

Mayor Tune stated since he has been involved he has found there are more grant funds out there than realized, and now realizes there are grants and loans for all types of needs, and he is strategically working on items for City. Mayor Tune suggested to Council members and citizens to stop by the Fire Hall during training to watch all they do. Mayor Tune then thanked Chief Martin and Fire Fighters for all they do.

POLICE REPORT
Councilman Ball stated that since Councilman Fitzgerald was unable to attend the meeting, that he would be giving the report. He further stated that 1 person appointed to the Board by Mayor Tune would not be able to fulfill position, and that the Mayor would need to appoint another Board member. Councilman Ball also stated that they had gotten SOP's from Murfreesboro and Chapel Hill for their Police Departments, and that they would be using them to update the current SOP's for Eagleville Police Department.

ZONING REPORT
Codes Administrator Linda Dansby stated that Fire Chief David Martin should be commended for bringing to the attention of the Council the need for water pressure. Ms. Dansby also stated that the Planning Commission met and since there were no business items on the agenda, spent the time getting in 1 hour of their mandatory 4 hour training per year as required by the State. Ms.,. Dansby then stated that she had met with the Rutherford County City Engineering Department, and there was no contract in writing for the inspections of roads and drainage. She then presented to the Council a copy of a contract in resolution form for their approval for the Rutherford County Engineering Department to perform roadway and drainage inspections for $25 per inspection. Ms. Dansby told the Council that once the contract/resolution is approved by them, then it will need to go before the County Board for their approval. Councilwoman Jensen stated she would like to get copies of items prior to the meeting, and does not like voting on items without having time to review. Councilman Ball stated he thought $25 per inspection was a good price. Discussion ensued on how the City Recorder, Planning Commission and County would work together for inspections, how currently the City did not have anyone qualified to do inspections, how this would help the Planning Commission and the details of the agreement. After discussion Vice Mayor Ronnie Hill made a motion to approve the contract as Resolution 09-04, with Councilman Darin Rowell seconding. After a roll call vote taken by City Recorder Colleen Adams, the motion passed 4-0, with Councilwoman Jensen voting "no".

RECORDS REPORT
Glenda Dyer reported to the Council that a letter had been received saying MTAS was ready for the codes and stated that maybe the Council would like to have a workshop to update and approve any changes. Ms. Dyer stated that once the Council has reviewed a Public Hearing would need to be done, and then would need to pass the 3rd reading. She stated she has not worked on any other projects since this has a deadline. Ms. Dyer stated she has recommendations from changes or updates to the Municipal Codes, and has given each Councilmember a copy of those recommended changes and the section relating to it. Mayor Tune asked Councilwoman Jensen to coordinate a workshop for the Council to review the changes.

SEWER REPORT
Mayor Tune stated that the Sewer Selection Committee met with SEC on September 29, 2009 for the 3rd time to coordinate, and that he is continually working with them and continuing to look for funding and grants. Mayor Tune stated that SEC should have a
presentation within the next 45-50 days and that the City is fortunate to have them, and they are working very hard.

OLD BUSINESS

Strategic Planning
Councilman Darin Rowell reported that he has sent emails to the Core Committee members to meet first, and then they will reach out to community. He further stated a meeting of the Core group will be in two weeks.

Employee Oversight Committee
Councilman Ball stated that since Councilman Fitzgerald was not there, he would be speaking. Councilman Ball then presented to Mayor and Council members an updated and proposed Personnel Policies and Procedures manual. He further stated he would like for the Council to have a1st reading tonight, and then take home and review.

City Recorder Colleen Adams, asked to address the Mayor and Council, and asked if the changes would replace current policies for current employees, and was told most likely by Councilman Ball. Ms. Adams asked for clarification that current benefits the current employees are now receiving would be taken away, and was told yes by Councilman Ball. Councilman David Rigsby stated it was not right to take away something current employees are already receiving, and that these changes should be for future employees. Councilman Alan Ball made a motion for approval of the 1st reading for the updated and changed Personnel Policies and Procedures. Councilman Darin Rowell seconded the motion, and after a roll call vote taken by City Recorder Colleen Adams, the motion passed 4-1, with Councilman David Rigsby voting "no".

Pay Raise for City Recorder
Councilman Ball stated that he would like to discuss a pay raise for City Recorder Colleen Adams. Councilman Ball stated that Ms. Adams has received her State certification for City Recorder and can now begin CMFO certification, and that she has increased duties and meeting due to new Boards, and is asking the Council to determine amount to be given. After a discussion, it was determined that a 4% increase to base salary would be given to the City Recorder and that the increase would be retroactive to July 1, 2009. Vice Mayor Ronnie Hill made a motion to approve, with Councilman David Rigsby seconding. After a roll call vote by City Recorder Colleen Adams, the motion passed 5-0.

Guns In Park - Resolution 09-04
Councilman Alan Ball made a motion to pass Resolution 09-03 - No Guns in Park. Councilman Darin Rowell seconded the motion, and after a short discussion a roll call vote was taken by City Recorder Colleen Adams. The motion passed 5-0.


Bridge on Clark Street
Mayor Tune stated that the bridge on Clark Street is not a bridge. Mayor Tune stated that TDOT came out to inspect at the City's request, and was told by them that it is a culvert. Mayor Tune further stated that according to TDOT, guardrails were recommended, but no weight limit sign or other work was required.

NEW BUSINESS
NONE.

ADJOURNMENT
Mayor Tune addressed Mr. and Mrs. Lamb, and thanked them for all they have done, and stated how much the community appreciates their work. Mayor Tune thanked all for being here. A motion was made by Councilman David Rigsby to adjourn, with Councilman Darin Rowell seconding. With unanimous approval, the meeting ended at 8:49 p.m.
