                                  PLANNING COMMISSION MEETING
                                 JULY 6, 2009            6.30 PM

The Mayor and the Planning Commission members met in a regular session in the Eagleville City Hall, City of Eagleville, Rutherford County, Tennessee, Monday, July 6, 2009.


CALL TO ORDER

The following members were present:

CITIZENS INUT
Chairman Nick Duke invited any guest to speak on any issue.

Citizen, Phil Williams talked about the Board of Zoning Appeals giving a variance for a parcel of land to a business owner on Clark Street. Mr. Williams was concerned about traffic, the structural nature of the bridge, and potential hazards that might occur. Mr. Williams stated the owner should have been made to construct a bridge. After his five minutes, Mr. Williams asked to readdress the Planning Commission. Dustin Owens, State Planner, recommended to Mr. Williams to address the Board of Zoning Appeals during their next meeting. The Planning Commission and Board of Zoning Appeals are two different entities with different powers delegated to them by the Board of Mayor and Alderman.

A citizen addressed the Planning Commission in regards to Turner Lane. Mr. Lewis addressed Bobby Turner on the ownership, deed, and easements concerning the road. No evidence (i.e.:, plats or deeds) were given to the Planning Commission regarding the road or surrounding property.

BUSINESS
Site Plan:
(John Lewis, Tax Map 1441, Group A, Parcel 21, Clark Street, 4.91 acres)

Mr. Lewis presented a plat to the Planning Commission in the form of a site plan. The issue at hand was a line extension and easement being granted from one property to another (both parcels being owned by Mr. Lewis). Mayor Tune inquired why Mr. Lewis would need to come before the Planning Commission in order to have an easement to his own property. Dustin Owens stated that anytime easements or property lines are changed, a plat needs to be submitted to the Planning Commission. Mr. Lewis and Mr. Tune led a discussion on the size of the easement needed for the proper line extension. The Planning Commission recommended to Mr. Lewis to hire a soil scientist to assist in the determination of the size of the easement, since one cannot build upon it. Mr. Lewis agreed with the recommendation.

Training:
Members discussed what type, location and times for additional training, and the issue was deferred until the next planned Planning Commission meeting.

Zoning Map:
Linda Lichtenberger, Zoning Administrator, requested a Color PDF version of the Zoning Map for the City of Eagleville with the Flood Areas and Parcels shown. Dustin Owens stated a request will be filed with the State Local Planning Office.
