The Mayor and the Planning
Commission members met in a regular session in the Eagleville City Hall, City of Eagleville, Rutherford County, Tennessee,
Monday, August 3, 2009.

Chairman Nick Duke invited any guest to speak on any issue. No residents spoke.
APPROVAL OF MINUTES
Councilman
Darin Rowell made a motion to approve the July 2009 minutes with the addition of Andy Soapes as a present member of the Planning
Commission. The motion was seconded by Mayor Sam Tune, and after a vote, the motion passed unanimously.
BUSINESS
Request for Annexation
Mayor Sam Tune submitted a request to annex into the City limits his home and 5 acres on Allisona Road. Codes Administrator
presented to the Planning Commission a timetable and checklist for annexations. Mayor Tune presented to the Planning Commission
a plan of service and map for the property he is asking to be annexed. Chairman Nick Duke stated the matter would need to
be presented to the City Council for approval. Councilman Darin Rowell made a motion to send the annexation request to the
City Council and was seconded by Andy Soapes. The motion passed with ah unanimous vote. Mayor Tune stated that per the Eagleville
City Charter, the eligibility requirements to be on the Council or Mayor is that a person needs to own property in the City
limits, but is not required to live in the City limits. Mayor Tune further stated he has had comments made to him regarding
his not living in the City limits and wants to show good leadership by having the annexation done. Chairman Nick Duke stated
the City is glad to have him.
Health
& Sanitation Report
Mayor Sam Tune stated to all in attendance that anyone
who thinks the Eagleville does not have a sewage problem is living under a rock, and presented to the Planning Commission
copies of reports showing pathogens in the local creek and river water, in which it showed a comparison of tests don in 2006
and 2009. Mayor Tune stated he is not sure why pathogens are there, but the amounts are over the State limits. Mayor Tune
further stated he has been working to see if it is feasible for Eagleville to get a sewer system. Mayor Tune went on to say
he wanted everyone to know the seriousness of the situation. He also reminded all in attendance that the City Council will
be having a called City Council meeting on Wednesday to discuss a sewer system, and that it is a complicated process and the
City needs to do a lot to qualify. Mayor Tune also presented to the Planning Commission a petition for them to sign stating
they support the seeking of funds for a sewer in Eagleville. Mayor Tune state it is their duty as appointed officials to protect
and secure the well-being of the citizens.
Codes
Report
City Planner Amy Miller stated she was unable to attend last months meeting
and gave to Ms. Lichtenberger a large color-coded zoning map. Codes Administrator Linda Lichtenberger stated she is still
researching the thourofare roads.
Training
City Planner Amy Miller asked if the Planning Commission would prefer to train in
one long session, or 2 smaller sessions. After discussion, Chairman Nick Duke suggested a lone afternoon session, with the
other members in agreement. Ms. Miller presented to the Planning Commission members a handbook for their use.
OTHER BUSINESS
John Lewis Property/Clark Street
Councilman Darin Rowell asked about the status of Mr. Lewis' requests. Chairman
Nick Duke stated the property in question was zones as C2 and the business is OK located there. Andy Soapes questioned if
the right decision had been made in granting the variance for the property at a past BZA meeting and did not want residents
to think they were doing anything underhanded or making wrong decisions. Codes Administrator Linda Lichtenberger reminded
the members that the decision was made by the Board of Zoning and Appeals, and not the Planning Commission, and although the
members are the same, the discussion should take place at a BZA meeting. Councilman Rowell questioned whether the variance
was granted only to the business located there now or would apply to future owners/business of the property. Andy Soapes stated
the people before them had created a mess and he was afraid Mr. Lewis would suffer. Mayor Tune stated he has been very public
about Clark Street and the controversy. Mayor Tune stated he had voted for Mr. Lewis to encourage new business and create
jobs in Eagleville. Mayor Tune stated the City has adopted Clark Street, but it shouldn't be accepted since it wasn't
up to codes. Mayor Tune further stated he had voted in a clear conscience to help Mr. Lewis, but is now unsure if it was the
right thing. Councilman Rowell encouraged the members to ask questions and spend extra effort to deliberate prior to making
decisions for the Planning Commission benefit and to encourage confidence with residents. Ms. Lichtenberger stated that the
variance was approved by the BZA, and not the Planning Commission. Mayor Tune stated when the variance was granted, they thought
they were doing the right thing, but it appears the road may not be suitable and if it needs to be reconsidered will do so.
Andy Soapes asked Ms. Lichtenberger if they did the right thing,
to which Ms. Lichtenberger stated she could not answer as she is not on the Board of Zoning and Appeals or the Planning Commission.
Chairman Nick Duke spoke and stated he felt the decision was the right one because the property is zoned C2.

With no other business to discuss, Chairman
Nick Duke moved to adjourn and was seconded by Mayor Sam Tune. By unanimous decision, the meeting adjourned at 7:09 pm.
